GUIDING Sample Clauses

GUIDINGThe Council’s use of planning agreements will be governed by the following guiding principles:  Development consent cannot be refused because a planning agreement has not been entered into or the proponent has not offered to enter into one;  A condition of development consent can only require a planning agreement to be entered into by a proponent strictly in accordance with an offer made by the proponent;  Planning agreements will not be used to xxxxxx the development assessment process;  Planning agreements will not improperly xxxxxx the exercise of discretion and the functions of Council under the Act, Regulation or any other Act or law;  Council will use planning agreements only for a proper planning purpose and a purpose which stands the tests of fairness, reasonableness and equity;  The interests of individuals or interest groups will not outweigh the public interest when considering, negotiating and finalising a planning agreement;  Council will not use its statutory position to gain unreasonable public benefits from proponents when considering, negotiating, finalising, executing and implementing planning agreements;  Council will take appropriate steps to ensure that it avoids any conflict of interest between its role as a planning authority when it has a commercial interest in the outcomes of a planning agreement;  Council will ensure that planning agreements are based upon sound, reasonable and accountable financial management;  Council will ensure that all processes and content of a planning agreement are transparent and soundly based upon probity;  Negotiation of a planning agreement is to be entered into in good faith by all parties; and  The planning agreement reflects the priorities of the community as identified in Council’s Community Strategic Plan.
GUIDING. Guide outfitter licences and certificates and angling guide licences which exist as of the Effective Date and apply to an area wholly or partially on In-XXXXX-ch Nation Land will be set out in Appendix C to the Final Agreement, will be retained by the persons who hold those interests and may be transferred or renewed in accordance with Provincial Law.
GUIDING. The Final Agreement will include provisions in respect of Nisga'a guide outfitting.
GUIDING. 11.17.1 Guide outfitter certificates existing on the Effective Date are listed in Part 2 of Appendices E-11 to E-15, are retained by the persons who hold those guide outfitter certificates, and may be transferred or renewed in accordance with Provincial Law. 11.17.2 The applicable Maa-nulth First Nation will allow reasonable access on its Maa-nulth First Nation Public Lands for the purpose of carrying out guiding activities to any person who: a. holds a guide outfitter certificate listed in Part 2 of Appendices E-11 to E-15, or any renewal or replacement thereof; b. holds a guide outfitter licence or assistant guide licence and is carrying out guiding activities in relation to a guide outfitter certificate area listed in Part 2 of Appendices E-11 to E-15, or any renewal or replacement thereof; c. holds an angling guide licence; d. holds an assistant angling guide licence; or e. is an employee, agent or other representative of any person listed in a. to d. 11.17.3 If a guide outfitter certificate that applies to Maa-nulth First Nation Lands becomes vacant by reason of abandonment or operation of law, any new guide outfitter certificate issued by British Columbia will not include Maa-nulth First Nation Lands without the consent of the applicable Maa-nulth First Nation.
GUIDING. PRINCIPLES Buyer and Supplier will strive to communicate timely, openly, and honestly to accomplish the business objectives embodied in this Agreement. Buyer and Supplier will strive to continue a long- term business relationship by developing mutual trust, cooperation, and goodwill through their performance under this Agreement.
GUIDING. Guide outfitter licences and certificates and angling guide licences which exist as of the Effective Date and apply to an area wholly or partially on Yekooche First Nation Lands, will be set out in Appendix G to the Final Agreement, will be retained by the persons who hold those interests and may be transferred or renewed in accordance with Provincial Law.

  • Scheduling i) The designated employer will provide the employee with their schedule of shifts in accordance with the collective agreement for both homes. [Insert the split/sharing of shift numbers here] Similarly, the employee will submit all requests for time off including vacation to the designated employer in accordance with the collective agreement. ii) Posted schedules will include home identification. An employee will only be scheduled in one home per shift. iii) Overtime payment and other premiums will be in accordance with the collective agreement of the designated employer. iv) Weekends off, consecutive work days and all other scheduling provisions will be in accordance with the collective agreement at the designated employer.

  • Operational All expenses for running and operating all machinery, equipments and installations comprised in the Common Areas, including elevators, diesel generator set, changeover switch, pump and other common installations including their license fees, taxes and other levies (if any) and expenses ancillary or incidental thereto and the lights of the Common Areas and the road network.

  • Coordination The Developer and Connecting Transmission Owner shall confer regularly to coordinate the planning, scheduling and performance of preventive and corrective maintenance on the Large Generating Facility and the Attachment Facilities. The Developer and Connecting Transmission Owner shall keep NYISO fully informed of the preventive and corrective maintenance that is planned, and shall schedule all such maintenance in accordance with NYISO procedures.
