Habitation Sample Clauses
Habitation. If the Property or part of the Property is destroyed or made uninhabitable by any insured risk, and provided such damage is not as a result of any fault or negligence on the part of the Tenant, his/her family, visitors or guests:
i. The Rent will cease to be payable until such time as the Property is reinstated and rendered habitable;
ii. In the event that the extent of the damage is such that the Property is not made habitable within one month, either party may terminate the Tenancy by giving immediate written notice to the other party.
Habitation. If the Property or part of the Property is destroyed or made uninhabitable by any insured risk, and provided such damage is not as a result of any action or misuse or negligence of the Tenant, a third party, any family or visitors, whether invited or not.
Habitation. The demised premises shall not be used for human habitation, other than a night watchman or patrolman as approved by the Director.

If the Property or part of the Property is destroyed or damaged by any insured risk so as to be unfit for occupation or use, and provided such damage is not as a result of any fault or negligence on the part of the Tenant or any invitee of the Tenant which would as a consequence make the Landlord’s insurance invalid:
(i) the rent or a fair proportion according to the nature and extent of the damage sustained shall be suspended and cease to be payable until such time as the Property shall again be rendered fit for occupation and use, or
(ii) in the event that the extent of the damage is such that the Property is unfit for occupation or use for a period in excess of one month either party may give written notice to terminate the Tenancy immediately and any rent, or a fair proportion according to the nature and extent of the damage sustained, paid for a period after the date of the termination shall be paid to the Tenant by the Landlord,
(iii) provided always that it is understood that the Landlord shall not be liable to pay any compensation to the Tenant.
Habitation. At the time the Tenant(s) accept possession the Premises will be considered habitable.
Habitation. The Grantor reserves the right to reside on the Protected Property in existing (or future) permitted structures as well as use, maintain and enjoy the Protected Property in any way which is not expressly prohibited or which may be detrimental to the intent and Purpose of this Easement. Habitation. A. There will be no habitation (living, sleeping, etc.) on common property pool area or on patios or balconies.
B. No furniture designated for this purpose will be allowed to be places or stored on patios or balconies.

If the Property or part of the Property shall be destroyed or damaged by any of the risks against which the Landlord shall have insured so as to be unfit for occupation or use then the rent or a fair proportion according to the nature and extent of the damage sustained shall be suspended and cease to be payable until the Property shall again be rendered fit for occupation and use PROVIDED always that
(i) the Landlord will not be liable to pay compensation to the Tenant and
(ii) the Landlord’s insurance shall not have been made invalid as a consequence of any act or omission on the part of the Tenant or any invitee of the Tenant.
Habitation. The Concession Premises shall not be used for human habitation.
Habitation. The concession premises shall not be used for human habitation, other than as approved night watchman or patrolman, except for concession premises resigned, constructed and operated for the express purpose of accommodating human habitation.
