Hazardous Substance Assessments. A hazardous waste site assessment report addressed to the Agent (or the subject of a reliance letter addressed to, and in a form reasonably satisfactory to, the Agent) concerning Hazardous Substances and asbestos on such Real Estate dated or updated not more than ninety (90) days prior to the inclusion of such Real Estate in the Collateral, from the Environmental Engineer, such report to contain no qualifications except those that are acceptable to the Required Lenders in their reasonable discretion and to otherwise be in form and substance reasonably satisfactory to the Agent in its sole discretion.
Hazardous Substance Assessments. The Agent shall have received a hazardous waste site assessment report concerning Hazardous Substances and asbestos on the Mortgaged Properties, dated as of a recent date, from environmental engineers reasonably acceptable to the Agent which report shall have been approved by the Agent and all Lenders.
Hazardous Substance Assessments. The Agent shall have received hazardous waste site assessment reports running in favor of the Agent and the Banks concerning Hazardous Substances (or the threat thereof) and asbestos with respect to the Initial Eligible Properties, dated as of a date satisfactory to the Banks, from environmental engineers acceptable to the Agent, such reports to be in form and substance satisfactory to the Agent and each of the Banks. The Agent shall have the right to obtain third-party review of the reports at the Borrower's expense.

A Phase I environmental site assessment report concerning Hazardous Substances and asbestos on such Real Estate dated or updated not more than six (6) months prior to the inclusion of such Real Estate in the Collateral, from an Environmental Engineer, such report to contain no qualifications except those that are acceptable to the Majority Banks in their sole discretion and to otherwise be in form and substance satisfactory to the Majority Banks.
Hazardous Substance Assessments. A Phase I environmental site assessment addressed to the Agent (or the subject of a reliance letter addressed to, and in a form reasonably satisfactory to, the Agent) concerning Hazardous Substances and asbestos on such Real Estate dated or updated not more than one (1) year (unless otherwise approved by the Agent) prior to the inclusion of such Real Estate in the Collateral, prepared by an Environmental Engineer, in form and substance reasonably satisfactory to the Agent.
Hazardous Substance Assessments. A hazardous waste site assessment report concerning Hazardous Substances and asbestos on such Real Estate dated or updated not more than three months prior to the inclusion of such Real Estate in the Collateral, from an Environmental Engineer, such report to contain no qualifications except those that are acceptable to the Majority Banks in their sole discretion and to otherwise be in form and substance satisfactory to the Majority Banks.
Hazardous Substance Assessments. To the extent requested by the Agent, the Agent shall have received hazardous waste site assessment reports running in favor of the Agent and the Lenders concerning Hazardous Substances (or the threat thereof) and asbestos with respect to the Eligible Unencumbered Properties dated no earlier than 30 days prior to the Closing Date (or such longer period of time as may be approved by the Agent), from environmental engineers acceptable to the Agent, such reports to be in form and substance satisfactory to the Agent and each of the Lenders. The Agent shall have the right to obtain third-party review of the reports at the Borrower’s expense.

Hazardous Substance Assessments. The Bank shall have received current Phase I environmental site assessment reports for those Developed Lots at the Strategic Projects which are included in the calculation of the Borrower's Availability, and any existing improvements thereon, which is complete and free of qualification, prepared by qualified and reputable civil or environmental engineers acceptable to the Bank, all at Borrower's expense indicating that the Developed Lots (except for the Developed Lots listed on Schedule 10.10, annexed hereto) are free and clear of Hazardous Substances. Such reports will be reviewed by an independent professional engineering firm designated by the Bank, the costs of such review to be borne by each of the Parties.
