The Agent shall have received hazardous waste site assessments from environmental engineers and in form and substance satisfactory to the Agent, covering all Eligible Real Estate Assets and all other real property in respect of which any Borrower or any of its Affiliates may have material liability, whether contingent or otherwise, for dumping or disposal of Hazardous Materials.
