HIRING PROCEDURE. a. Selections for Regular Faculty i. Internal Selections for Regular Faculty from Regular Faculty (1) Regular faculty members who apply for a regular position will be treated as internal candidates, who will be considered before an external search. If a Selection Committee determines that the internal candidate is qualified for the position and recommends appointment, the appointment will be made. (2) Where there are two (2) or more qualified regular faculty members, the position shall be awarded to the faculty member with the greatest DDP FTE Service. Where there is a tie in DDP FTE service, the lottery process in Article 6.07.c will apply. (3) Should the Responsible Administrator not wish to follow the Selection Committee’s recommendations in making the appointment, he/she shall meet with the Committee to provide a rationale and attempt to resolve the matter before taking action. (4) Faculty members hired through the internal selection process will be subject to a one (1) year probationary period. (5) Internal candidates may take an unpaid leave of absence from their original position in accordance with Article 7 of the Common Agreement. (6) Internal regular faculty members who are not selected shall, upon request, receive feedback from the Responsible Administrator. ii. Internal Selections for Regular Faculty from Contract Faculty (1) The Selection Committee shall interview contract faculty members who apply, have two (2) years of DDP FTE Service, and have been evaluated as satisfactory during their second year of DDP FTE Service. Where a faculty member has more than three (3) years of DDP FTE Service, his/her most recent evaluation must be satisfactory. (2) The Selection Committee shall assess the candidates to ensure they meet the qualifications and criteria established by the Selection Committee for a regular position. (3) Where the Selection Committee determines that a candidate meets the qualifications and criteria for a regular position, he/she will be recommended by the Selection Committee for appointment and a regular appointment shall be made when there is work of half-time or more available in the DDP that the faculty member is qualified to teach. Where a faculty member has been recommended, the Responsible Administrator shall appoint. (4) An applicant who does not meet the qualifications and criteria for a regular ongoing position, but has two (2) years of DDP FTE Service, may be considered by the Selection Committee. Where the Selection Committee determines that he/she can be reasonably expected to meet the qualifications and criteria during the first year of the regular appointment, he/she shall be recommended and appointed to a position provided he/she is qualified for the courses he/she is required to teach. In these cases the letter of appointment shall specify the criteria and/or qualifications that must be met. If the qualifications and criteria established in writing by the Selection Committee are not met in the first year of the two- year probationary regular appointment, the faculty member shall be terminated. (5) Where there are two (2) or more qualified faculty members with regular status, the position shall be awarded to the faculty member with the greatest DDP FTE Service. Where there is a tie in DDP FTE Service, the lottery process in Article 6.07.c will apply. iii. Contract Faculty Applying for Regular Status for Subsequent Appointment as Regular Faculty (1) When a contract faculty member has two (2) years DDP FTE Service, and is evaluated as satisfactory in the second year of his/her DDP FTE Service, he/she may apply to his/her DDP Selection Committee for regular status as defined in Article 1.03.

HIRING PROCEDURE. a. Selections SECTION 1. The Union will be the sole and exclusive source of referrals of applicants for Regular Facultyemployment with signatory employers for all worker classifications. i. Internal Selections SECTION 2. The Employer shall have the right to reject any applicant for Regular Faculty employment. SECTION 3. The Union shall select and refer all qualified applicants for employment without discrimination against such applicants by reason of membership or non-membership in the Union and such selection and referral shall not be affected in any way by rules, regulations, bylaws, constitutional provisions, or any other aspect or obligation of the Union membership policies or requirements. All such selection and referral shall be in accordance with the following procedure. SECTION 4. The Union shall maintain a register of applicants for employment. Applicants shall be listed in chronological order of the dates they register. If the registration list is exhausted, and the Union is unable to refer applicants for employment to the Employer within forty-eight (48) hours from Regular Facultythe time of receiving the Employer’s request, Saturdays, Sundays and holidays excepted, the Employer shall be free to secure applicants without using the referral procedure. The Employer shall notify the Union promptly of the names, addresses and Social Security numbers of such directly-hired employees. (SECTION 5. Employers shall advise the Union of the number of qualified applicants needed, the work to be performed, the work or project location, the starting time, the name of the person the applicant is to report to, the name of any individual that the Employer requests by name who was formerly employed by the Employer and any special skills or abilities involved. The Union shall refer qualified applicants to the Employer by the order of their places on the register and provide the employer with a Referral Placement Form, via fax, e-mail, or some other form of electronic communication, which shall contain the name, classification, wage rate, start date, starting time, the work or project location, and person the applicant is to report to, work to be performed and whether there are any special skills or certifications required, or whether the qualified applicant was requested by name because of being formerly employed by the employer. No member shall be allowed to by- pass the referral procedure. SECTION 6. Any applicant who is rejected by the Employer shall be returned to his/her appropriate place on the register, and shall be referred to other employment in accordance with the position on the register. SECTION 7. The only exceptions which shall be allowed in this order of referral are as follows: 1) Regular faculty members who apply When the Contractor states bona fide requirements for a regular special skills and abilities in the request for applicants, the District Council shall refer the first qualified applicant on the register possessing such skills and abilities; 2) The Employer may request any member of the Union regardless of that member’s position will be treated as internal candidateson the register, who will be considered before an external search. When any member is laid off, voluntarily quits, is discharged or terminated for just cause the employer will furnish notification of such by submitting a Lay-Off – Voluntarily Quit – Termination Form to SECTION 9. Should any member referred for employment be terminated for just cause, his or her referral privileges shall be suspended for two weeks. Should the same individual be terminated for cause a second time within a twenty-four (224) Where there are month period, his or her referral privileges shall be suspended for two (2) months. HIRING PROCEDURE. a. Selections (a) Hiring. The parties agree to the following: 1. Weekly vacancy notices will be posted every Wednesday on a year round basis and will remain open for Regular Facultyten business days. 2. Vacancies will be posted on the district’s online recruiting website. All employees interested in transferring or applying for a position may apply via the district’s electronic application system via the online recruiting website. The District shall place instructions for use of the electronic application system on the district’s website and also make them accessible to employees upon request. Human resources will have work stations for employees to submit electronic applications. 3. The posting will include the job title, site, hours per day, number of workdays per year and shift if applicable. People who meet the minimum qualifications may apply for the position(s) in which they have interest. Once a person passes the appropriate test for a job classification, they need not be retested. The District records the test score(s) for an employee and maintains it in their information system. i. Those meeting the minimum qualifications will be placed in the following order by Seniority: i. Laid off employees on the active 39 month re-hire list shall automatically be recalled in seniority order in the appropriate classification and placed in the vacancy. Recalling an employee from the active 39 month re-hire list will be done by phone and/or mail. It is the employee’s responsibility to provide updated contact information to the District; ii. If there are no laid off employees in the classification, then transfers of employees are next, which is defined by: salary range for Regular Faculty Office and Technical and by job classification for all other units; iii. Promotions within the unit; iv. Voluntary demotions within the unit; v. Promotions or demotions for WCCUSD permanent employees; vi. Local One substitutes; and vii. All others. 5. Any special needs, certifications, and/or requests of the position will be listed on the posting. 6. The top four candidates, as per number 4 (iii) - 4 (vii) above, will be interviewed by the Appropriate supervisor, manager and/or administrator, who shall make a selection amongst the four. 7. Test and qualifying scores shall be developed by the Human Resources office and shall be related to the actual requirements of the job as specified in the job description. Applications can be submitted online with all attached and required documents attached. 10. The labor management group shall meet on a regular basis to his/her DDP Selection Committee discuss items of mutual interest of the parties and explore improvement of contractual processes.
