Historic Resources. As noted in Chapter 5, “Historic Resources,” the Proposed Action could have an adverse effect on a number of the remaining remnants on the World Trade Center that contribute to the WTC Site’s historic significance. In order to minimize or mitigate any such effects, LMDC has proposed to enter into a Programmatic Agreement with the New York State Historic Preservation Officer (SHPO) and the Advisory Council on Historic Preservation that would include specific commitments with respect to the treatment or removal of such remnants and procedures for consultation with SHPO and those consulting parties who participated in the Section 106 process referred to in Chapter 5. Historic Resources. Project historians will prepare a Historic Project Coordination Request (PCR) for submittal to TxDOT. The PCR will include database searches of the THC Historic Sites Atlas to identify previously documented archaeological sites, cemeteries, historical markers, properties and districts listed on the NRHP, and SALs. If required, the ENGINEER will prepare a research design for review and comment by the CITY and TxDOT. The research design will conform to the TxDOT SOU: Non-Archaeological Historic-Age Resource Research Designs Review Checklist. If required, project historians will perform a reconnaissance survey to document each historic-age resource within the study area. The ENGINEER shall provide a report detailing the results and findings of the reconnaissance survey, including effects to historic properties and the need, if any, to conduct future intensive survey efforts.
Historic Resources. Pursuant to Section 106 of the NHPA of 1966 and applicable guidance, the Corps has reviewed the latest published version of the National Register of Historic Places and initially determined that implementation of the PA will not adversely affect registered properties listed as eligible for inclusion, therein. Participation in the PA will streamline coordination and review of projects that have no effect or no adverse effects on properties listed or eligible for listing on the National Register of Historic Places.
Historic Resources. Request for Project Review Dam repair or removal would require a federal permit through the US Army Corps of Engineers and will therefore be subject to review under Section 106 of the National Historic Preservation Act. VHB will assist the VHB Team in state and federal historic regulatory review requirements. Compliance with Section 106 of the National Historic Preservation Act is coordinated through the New Hampshire Division of Historical Resources (NHDHR) as the New Hampshire State Historic Preservation Office. To initiate this coordination, VHB, with support from an archaeological subconsultant, will prepare a Request for Project Review (RPR) for submittal to NHDHR as follows:

Assume no detailed study is required for Historical resources beyond the Phase 1A and 1B Cultural Resource surveys. The Section 106 (Section 14.09) review process will be coordinated by NYSDOT. Assume no Section 4(f) or Section 6(f) detailed studies will be necessary. No separate Section 6(f) report will be required.
Historic Resources. The Contributing Buildings and Landscape Features which have the potential to be adversely affected by this Undertaking, and the steps to be taken to resolve those adverse effects, in accordance with this MOA, are noted below:
Historic Resources a. The Engineer shall complete the project coordination request and submit to the State for internal management and approval. The Engineer shall perform non-archeological historic-age resource studies to document compliance with Section 106 and Section 110 of the National Historic Preservation Act (NHPA) (36 Code of Federal Regulations [CFR] 800) in accordance with the approved PCR. Such studies shall include non- archeological historic-age resource surveys, research and documentation. Historic resource studies shall be performed and documented at sufficient levels to satisfy THC requirements for determining the presence of and documenting historically significant properties in the project Area of Potential Effect (APE) in accordance with 36 CFR 60 and 43 Texas Administrative Code (TAC) 2.4-2.51 so that the work performed would be in compliance with State requirements.
