Import Export Requirements. Vendor will certify to, and mark Products and packaging with, the country of origin for each Product so as to satisfy the requirements of customs authorities of the country of receipt and any other applicable laws. If any Products are imported, Vendor will, at Buyer's request, either (i) allow Buyer to be the importer of record or (ii) provide Buyer with any documents required to prove importation and to transfer duty drawback rights to Buyer.

Import Export Requirements. 14.1 BROCADE will certify to, and mark Xxxducts and packaging with, the country of origin for each Product so as to satisfy the requirements of customs authorities of the country of receipt and any other applicable laws. If any Products are imported, Dell will be the importer of record. BROCADE and Dell shall comply with all import and export laws and regulations and maintain appropriate import and export documentation. At Dell's request, BROCADE shall make available for inspection and audit all import and export documentation for Product(s) sold under this Agreement. At Dell's request, BROCADE shall also provide an appropriate Export Control Classification Number ("ECCN") for all Product(s) sold hereunder. 14.2 BROCADE shall not, directly or indirectly, export, re-export or tranship Products in violation of any applicable U.S. export control laws and regulations or any other applicable export control laws promulgated and administered by the government of any country having jurisdiction over the parties or the transactions contemplated herein.
Import Export Requirements. Seller warrants that the delivery and installation of the Deliverables shall comply with all export and import requirements of the county(ies) of origin of the Deliverables and of the United States. Seller shall be solely liable for compliance with any import or export requirements including the payment of any fees, fines, levys, taxes, surcharges, customs duties associated with the delivery and installation of the Deliverables.

Import Export Requirements. Reference of DFAR’s and ITAR requirements will be stated on Advanced Technology Company Purchase order as required by contract. Seller shall be compliant in the specific areas as required and are subject to Quality Audit to verify DFAR and ITAR compliance by Advanced Technology Company and /or our customers. Any ITAR drawings submitted with this purchase order must be destroyed by suitable means upon completion or returned to ATCo.
Import Export Requirements. 14.1 SUPPLIER acknowledges that the Products licensed or sold under this Agreement, and the transaction contemplated by this agreement, which may include technology and software, are subject to the customs and export control laws and regulations of the United States (“U.S.”) and may also be subject to the customs and export laws and regulations of the country in which the Products are manufactured and/or received. SUPPLIER agrees to abide by those laws and regulations. Further, under U.S. law, the Products may not be sold, leased or otherwise transferred to restricted end-users or to restricted countries. In addition, the Products may not be sold, leased or otherwise transferred to, or utilized by an end-user engaged in activities related to weapons of mass destruction, including without limitation, activities related to the design, development, production or use of nuclear weapons, materials, or facilities, missiles or the support of missile projects, and chemical or biological weapons. 14.2 SUPPLIER agrees not to provide any written regulatory certifications or notifications on behalf of Dell without first seeking prior written approval from Dell’s Export Compliance Representative. When applicable and necessary, Dell will provide SUPPLIER with all U.S. export licenses, license designations, National Defense Authorization Act (“NDAA”) authorizations and commodity classifications unless otherwise agreed to in writing by SUPPLIER and Dell and unless SUPPLIER is obligated to obtain the license under U.S. law. 14.3 SUPPLIER is prohibited from diverting any Dell shipment without first securing written approval from Dell’s Export Compliance Representative. SUPPLIER agrees not to support or engage in any boycott related transaction and/or requests in order to execute a transaction on behalf of Dell. 14.4 In addition, SUPPLIER agrees to indemnify, defend and hold Dell harmless from any loss, expense, penalty or claim against Dell due to SUPPLIER’S violation or alleged violation of any such applicable laws and regulations. 14.5 Further, regarding processing Shippers Export Declarations (SED) or the Automated Export System (AES), Dell will retain the right to name its own Freight Forwarder in all transactions. Dell may, at its sole discretion, permit the SUPPLIER to name its own Freight Forwarder for the purpose of clearing outbound Customs from the United States. Import Export Requirements. In the event any Product supplied under this Agreement is imported for sale to Exabyte, Seller agrees to allow Exabyte to be the importer of record where possible. Exabyte reserves the right to file, and Seller hereby transfers to Exabyte, all third party duty drawback claims. The Seller will provide all necessary documents to Exabyte for duty drawback claims in accordance with US Customs regulations. Seller shall xxxx every Product or its container with the country of origin and otherwise comply with all applicable import rules, regulations and laws. Seller shall notify Exabyte if Product falls under any export restrictions.
Import Export Requirements. Foxconn shall 1) comply with all import and export laws and regulations and maintain appropriate import and export documentation, 2) provide an appropriate certification stating the country of origin for Products sufficient to satisfy the requirements of the Governmental Authorities of the destination country or countries and any applicable customs or import/export regulations of such countries, including without limitation those of the United States, 3) ensure that Products and packaging of Products are marked with the country of origin, as required by applicable regulations of any jurisdiction or as otherwise reasonably requested by TB, 4) at TB's request, (a) make available for inspection and audit all import and export documentation for the Products and technology included in the Products; (b) assist TB in determining an appropriate Export Control Classification Number for all Products; and (c) provide export screening for all shipments of Products or Parts. Foxconn will not, directly or indirectly, export, re-export or transship any Products in violation of any applicable U.S. export control laws and regulations or any other applicable export control laws promulgated and administered by the government of any country having jurisdiction over the parties or the transactions contemplated herein and, at TB’s request for product importation into the USA, designate TB or its designated customer as the importer of record and if TB is not the importer of record, provide TB with documents required by the customs authorities of the country of receipt to prove proper importation.
Import Export Requirements. Supplier will comply with all applicable export / import requirements. When Goods provided under this Supply Agreement originate outside of the United States, prior to its first shipment of goods to Buyer, Supplier shall provide Buyer a Certificate of Origin specifying the Country of Origin, including supplier name, Buyer, Purchase Order number, Buyer part number, and, as requested, any other documentation that is reasonably required for customs compliance.
