Inconvenience During Construction. Lessee recognizes that from time to time during the term of this Agreement it will be necessary for Lessor to initiate and carry forward programs of construction, reconstruction, expansion, relocation, maintenance and repair in order that the Airport and its facilities may be suitable for the volume and character of air traffic and flight activity which will require accommodation, and that such construction, reconstruction, expansion, relocation, maintenance, and repair may inconvenience or interrupt operations at the Airport. Lessee agrees that no liability shall attach to Lessor, its officers, agents, employees, contractors, subcontractors, and representatives by reason of such inconvenience or interruption, and for and in further consideration of the premises, Lessee waives any right to claim damages or other consideration therefore, provided, however, that this waiver shall not extend to, or be construed to be a waiver of any claim for physical damage to property resulting from negligence or willful misconduct.

Lessee agrees that no liability shall attach to Lessor, its officers, agents, employees, contractors, subcontractors and representatives by reason of such inconvenience or interruption, and for and in further consideration of the premises, Lessee waives any right to claim damages or other consideration therefore, provided, however, that this waiver shall not extend to, or be construed to be a waiver of, any claim for physical damage to property resulting from negligence or willful misconduct of the Lessor, its officers, agents, employees, contractors, subcontractors, and representatives. The Lessee shall be obligated to be pay all rent and fulfill all obligations of this Lease at all times, including, but not limited to, when access to the Airport is temporarily restricted due to routine construction, reconstruction, expansion, or other potential alteration of the airfield.

Tenant recognizes that from time to time during the term of this Agreement it will be necessary for the Landlord to initiate and carry forward extensive programs of construction, reconstruction, expansion, relocation, maintenance and repair in order that the Fremont County Airport and its facilities may be suitable for the volume and character of air traffic and flight activity which will require accommodation, and that such construction, reconstruction, expansion, relocation, maintenance, and repair may inconvenience or temporarily interrupt in its operations at the Fremont County Airport. Tenant agrees that no liability shall attach to Landlord, its officers, agents, employees, contractors, subcontractors and representatives by reason of such inconvenience or interruption, and for and in further consideration of the premises, Tenant waives any right to claim damages or other consideration thereof, provided, however, that this waiver shall not extend to, or be construed to be a waiver of, any claim for physical damage to property resulting from negligence or willful misconduct.

The Airline recognizes that from time to time during the term of this Agreement it will be necessary for the City to initiate and carry forward extensive programs of construction, reconstruction, expansion, relocation, maintenance and repair in order that the Airport and its facilities may be suitable for the volume and character of air traffic and flight activity which will require accommodation, and that such construction, reconstruction, expansion, relocation, maintenance and repair may inconvenience the Airline in its operations at the Airport. The City shall consult with Airline prior to taking any such action which would adversely affect the Airline’s operations at the Airport unless such action is necessitated by circumstances which in the opinion of the Manager pose an immediate threat to the health and safety of persons using the Airport. The Airline agrees that no liability shall attach to the City, its officers, agents, employees, contractors, subcontractors and representatives by reason of minor inconvenience or minor discomfort as a result of such action and, for and in further consideration of the lease of the Demised Premises, the Airline waives any right to claim damages or other consideration for such minor inconvenience of minor discomfort.
Inconvenience During Construction. CONCESSIONAIRE recognizes that from time to time during the Term of this Agreement, it may be necessary for CORPORATION to commence or complete programs of construction, expansion, relocation, maintenance and repair in order that the TERMINAL BUILDING and its facilities may be completed and operated as CORPORATION determines, and that such construction, expansion, relocation, maintenance and repair may inconvenience the CONCESSIONAIRE in its operation at the Airport. CONCESSIONAIRE agrees that no liability shall attach to CORPORATION or Eagle County, its officers, agents, employees, contractors, subcontractors and representatives by way of such inconveniences, and CONCESSIONAIRE waives any right to claim damages or other consideration therefrom, except for claims for damages caused by the sole negligence of Eagle County and CORPORATION's officers, agents and employees.

The Lessee recognizes that, from time to time during the term of the Lease, it may be necessary for the City to initiate and carry forward extensive programs of construction, reconstruction, expansion, maintenance, and repair for the Airport to be suitable for air traffic and flight activity. The Lessee agrees that no liability shall attach to the City, its officers, agents, employees, contractors, subcontractors, and representatives by reason of such temporary inconvenience or interruption, and waives any right to claim damages or other consideration thereof. This waiver shall not extend to, nor be construed to be a waiver of, any claim for physical damage to property resulting from negligent misconduct by the City.

Lessor shall ensure that Lessee’s access to Parcel C on the attached Exhibit A shall not be impeded, and if Lessor’s activities impede Lessee’s use of the Ramp premises, Lessor shall provide a comparable area for Lessee to conduct its business. Lessee agrees that no liability shall attach to Lessor, its officers, agents, employees, contractors, subcontractors and representatives by reason of such inconvenience or interruption, and for and in further consideration of the premises, Lessee waives any right to claim damages or other consideration therefore, provided, however, that this waiver shall not extend to, or be construed to be a waiver of, any claim for physical damage to property resulting from negligence or willful misconduct of Lessor, its officers, agents, employees, contractors, subcontractors and representatives.

Lessee recognizes that from time to time during the term of this Lease Agreement it will be necessary for the County to initiate and carry forward programs of construction, reconstruction, expansion, relocation, maintenance and repair in order that the Montrose County Regional Airport and its facilities may be suitable for the volume and character of air traffic and flight activity which will require accommodation, and that such construction, reconstruction, expansion, relocation, maintenance, and repair may inconvenience or interrupt operations at the Montrose County Regional Airport. Lessee agrees that no liability shall attach to the County, its officers, agents, employees, contractors, subcontractors, and representatives by reason of such inconvenience or interruption, and for and in further consideration of the premises, Lessee waives any right to claim damages or other consideration therefore, provided, however, that this waiver shall not extend to, or be construed to be a waiver of any claim for physical damage to property resulting from negligence or willful misconduct.
Inconvenience During Construction. At times it will be necessary for the Landlord to initiate and carry forward programs of construction, reconstruction, expansion, relocation, maintenance, and repair to the Airport and its facilities. Tenant agrees that no liability shall attach to the Landlord, its officers, agents employees, contractors or subcontractors, or any other representatives by reason of such inconvenience or interruption, and Tenant waives any right to claim damages for loss of revenue or any other consideration as a result of any interruption or inconvenience from such operations.

Lessee recognizes that from time to time during the term of this Lease it may be necessary for City to initiate and carry forward extensive programs of construction, reconstruction, expansion, relocation, maintenance and repair in order that the Glenwood Springs Airport and its facilities may be suitable for volume and character of air traffic and flight activity which will require accommodation and that such construction, reconstruction, expansion, relocation, maintenance, and repair may inconvenience Lessee in its operation at the Airport. Xxxxxx agrees that no liability shall attach to City, its officers, agents, employees, contractors, subcontractors and representatives by reason of such inconvenience or interruption.
