Common use of Introduction and Discontinuation of Extended Tours Clause in Contracts

Introduction and Discontinuation of Extended Tours. (a) Extended tours shall be introduced into any unit when: (i) sixty percent (60%) of the nurses so indicate by secret ballot; and (ii) the Hospital agrees to implement extended tours, such agreement shall not be withheld in an unreasonably arbitrary manner. (b) Extended tours may be discontinued in any unit when: (i) fifty-one percent (51%) of the nurses in the unit so indicate by secret ballot; or (ii) the Hospital because of (1) adverse affects on patient care, or (2) inability to provide a workable staffing schedule, or (3) a wish to do so for other reasons which are neither unreasonable nor arbitrary, states its intention to discontinue extended tours. (c) When notice of discontinuation is given by either party in accordance with paragraph (b) above,: (i) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and (ii) where it is determined that extended tours will be discontinued, affected nurses shall be given sixty (60) days' notice before the schedules are so amended.

(longer daily tour) (a) Extended tours shall be introduced into any unit when: (i) sixty eighty percent (6080%) of the nurses employee(s) so indicate by secret ballot; and (ii) the Hospital agrees to implement extended tours, such agreement shall not be withheld in an unreasonably unreasonable or arbitrary manner. (b) Extended tours may be discontinued in any unit when: (i) fifty-one fifty percent (5150%) of the nurses employee(s) in the unit so indicate by secret ballot; or (ii) the Hospital because of (1) adverse affects on patient care, or (2) inability to provide a workable staffing schedule, or (3) a wish to do so for other reasons which are neither unreasonable nor arbitrary, states its intention to discontinue extended tours. (c) When notice of discontinuation is given by either party in accordance with paragraph (b) above,: (i) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and (ii) where it is determined that extended tours will be discontinued, affected nurses employee(s) shall be given sixty forty-five (6045) days' notice before the schedules are so amended.

(b) Extended tours may be discontinued in any unit when: (i) fiftyseventy-one five percent (5175%) of the nurses in the unit so indicate by secret ballot; or (ii) the Hospital because of (1) adverse affects effects on patient care, or (2) inability to provide a workable staffing schedule, or (3) a wish to do so for other reasons which are neither unreasonable nor arbitrary, states its intention to discontinue extended tours. (c) When notice of discontinuation is given by either party in accordance with paragraph (b) above,: (i) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and (ii) where it is determined that extended tours will be discontinued, affected nurses shall be given sixty eight (60) days' 8) weeks’ notice before the schedules are so amended.

(ai) Extended tours shall be introduced into any unit when: (i1) sixty seventy-five percent (6075%) of the nurses employee(s) so indicate by secret ballot; and (ii2) the Hospital Employer agrees to implement extended tours, such agreement shall not be withheld in an unreasonably unreasonable or arbitrary manner; and (3) that a mutually agreed upon schedule has been developed. (bii) Extended tours may be discontinued in any unit when: (i1) fifty-one fifty percent (5150%) of the nurses employee(s) in the unit so indicate by secret ballot; or (ii2) the Hospital Employer because of (1a) adverse affects on patient resident care, ; or (2b) inability to provide a workable staffing schedule, ; or (3c) a wish to do so for other reasons which are neither unreasonable nor arbitrary, states its intention to discontinue extended tours. (ciii) When notice of discontinuation is given by either party in accordance with paragraph (b2) above,: (i1) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and (ii2) where it is determined that extended tours will be discontinued, affected nurses employee(s) shall be given sixty (60) days' notice before the schedules are so amended.forty-five

(b) Extended tours may be discontinued in any unit when: (i) fifty-one percent seventy per cent (5170%) of the nurses in the unit so indicate by secret ballot; or (ii) the Hospital because of: (1A) adverse affects effects on patient care, ; or (2B) inability to provide a workable staffing schedule, ; or (3C) a wish where the Hospital wishes to do so for other reasons which are neither unreasonable nor arbitrary, . iii) The Hospital because of ii) A or B or C states its intention to discontinue the extended tourstours in the schedule. (c) When notice of discontinuation is given by either party in accordance with paragraph (b2) above,, then: (i) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and (ii) where it is determined that extended tours the compressed work week will be discontinued, affected nurses shall be given sixty (60) days' days notice before the schedules are so amended.
