Education Leave. If required by the Hospital, an employee shall be entitled to leave of absence with pay and without loss of seniority and benefits to write examinations to upgrade his or her employment qualifications. Where employees are required by the Hospital to take courses to upgrade or acquire new employment qualifications, the Hospital shall pay the full costs associated with the courses. Subject to operational requirements, the Hospital will make every reasonable effort to grant requests for necessary changes to an employee's schedule to enable attendance at a recognized up-grading course or seminar related to employment with the Hospital."

Education Leave. (a) An employee may be granted education leave without pay for varying periods up to one (1) year, which can be renewed by mutual agreement, to attend a recognized institution for additional or special studies in some field of education in which special preparation is needed to enable the employee to fill his/her present role more adequately, or to undertake studies in some field in order to provide a service which the Council requires or is planning to provide. (b) Normally, an employee on education leave without pay under this clause shall receive an allowance in lieu of salary equivalent to from fifty percent (50%) to one hundred percent (100%) of his/her basic salary. The percentage of the allowance is at the discretion of the Council. Where the employee receives a grant, bursary, or scholarship, the education leave allowance may be reduced. In such cases, the amount of the reduction shall not exceed the amount of the grant, bursary or scholarship. (c) Any allowance already being received by the employee and not part of his/her basic salary shall not be used in the calculation of the education leave allowance. (d) Allowances already being received by the employee may, at the discretion of the Council, be continued during the period of education leave. The employee shall be notified when the leave is approved whether such allowances are to be continued in whole or in part. (e) As a condition to the granting of education leave an employee shall, if required, give a written undertaking prior to commencement of the leave to return to the service of the Council for a period of not less than the period of the leave granted. If the employee, except with the permission of the Council: (i) fails to complete the course, (ii) does not resume his/her employment with the Council following completion of the course, or (iii) ceases to be employed, except by reason of death or lay-off, before termination of the period he/she has undertaken to serve after completion of the course he/she shall repay the Council all allowances paid to him/her during the education leave or such lesser sum as shall be determined by the Council.

In this regard, the local parties will endeavour to provide flexible work schedules to accommodate the nurse’s time off requirements. (a) Leaves of absence, without pay, for the purposes of furthering professional nursing career development may be granted on written application by the nurse to the Chief Nursing Officer, Supervisor or designate. Requests for such leave will not be unreasonably denied. (b) A full-time or regular part-time nurse shall be entitled to leave of absence without loss of earnings from her or his regularly scheduled working hours for the purpose of writing any examinations required in any recognized course in which nurses are enrolled to enhance their nursing qualifications. For greater clarity, the period of the leave shall include the night shift prior to and any scheduled shifts commencing on the day of the examination as long as payment under this clause does not result in payment for more than one regularly scheduled shift. The nurse agrees to notify the immediate manager of the date of the examination as soon as possible after she or he has become aware of the date of the exam. (c) Leave of absence without loss of regular earnings from regularly scheduled hours for the purpose of attending short courses, workshops or seminars to further professional nursing career development may be granted at the discretion of the Hospital upon written application by the nurse to the Chief Nursing Officer, Supervisor or designate. (d) Regular part-time nurses will be credited with seniority and service for all such hours paid for writing examinations, attending courses, workshops or seminars to further career development as provided above.

Education Leave. (a) The Employer may grant a leave of absence without pay for educational purposes to a Nurse who has been employed for a minimum of one year. Such leave must be requested at least three (3) months in advance of the requested commencement date and the nature of the educational program must be directly related to the skills and requirements of the Employer. (b) A Nurse on Education Leave shall retain those benefits which accrued up to the time the Nurse commenced the leave of absence. The Nurse shall continue to accrue Service and Seniority during the leave of absence. (c) On return, the Nurse shall return to the same or equivalent previous position and appointment status that the Nurse had prior to commencing the leave, unless mutually agreed upon otherwise. (d) A Nurse on Education Leave may be permitted to work for the Employer while on Education Leave subject to the principles set out in Article 9.01. (e) Subject to the provisions of the applicable benefits plans, a Nurse on an educational leave of absence may maintain membership in the plans if the Nurse agrees to pay both the Employer and Employee share of the contributions.
Education Leave. (a) The Employer may enter into individual return of service agreements with Employees in relation to educational programs which extend for a period in excess of six (6) calendar months and where participation in the program by the Employee is voluntary. The Union shall be a party to all such agreements. (b) Where the Employer requires and authorizes in writing an Employee to pursue an educational program which specifically relates to job requirements, a full or partial leave of absence with pay may be granted to the Employee. Where leave is granted, the Employer will pay for tuition and books. (i) A leave of absence without pay may be granted to an Employee for the purpose of pursuing an educational program. (ii) The Employee shall have the option of maintaining the benefit plans in which the Employee participated prior to the commencement of the Employee’s education leave. (iii) The Employer shall notify the Employee of the option referred to in Article 19.17 (c)(ii) and the date beyond which the option may no longer be exercised at least ten (10) days prior to the last day on which the option could be exercised to avoid an interruption of benefits. (iv) Where the Employee opts in writing to maintain the benefit plan referred to in Article 19.17 (c)(ii), the Employee shall enter into an arrangement with the Employer to pay the cost required to maintain the benefit plan, including the Employer’s portion thereof, and the Employer shall process the documentation and payments as arranged. (v) Where operational requirements permit, and on reasonable notice, leave of absence for education purposes shall not be unreasonably denied. (d) Upon completion of education leave pursuant to this Article, an Employee shall be entitled to return to their former position. Where the position no longer exists, the matter shall be referred to the Joint Committee on Technological Change.
