Where the education, qualifications, experience, skills, abilities, and previous performance and fit of the candidate with the work group are judged to be relatively equal by the Employer, the Employee with the most seniority, as defined in Article 1 - Definitions, shall be considered over less senior Employees.
42.04 Where circumstances requires the Employer to fill a vacancy prior to the transferposting of the vacancy or/and prior to the conclusion of a formal competition, promotion the Employer may fill the position on a temporary basis, by either a Casual or Agency Employee. The College will hire employees on a casual basis over agency employees where qualified casual employees are available.
42.05 The Employer may use Agency Employees for a maximum of fourteen (14) weeks while the Employer evaluates the duties and required qualifications of the position, prepares a position description, determines the classification and posts and fills a vacancy, post the name of .
42.06 If the successful candidate with the posting number on the bulletin board provided for that purpose. The notice shall remain posted for five (5) calendar days. 16.07 When an Employee is transferred at the sole discretion of the Employer to a classification with a lower maximum salary, the Employee shall move to the step, of the lower paid classification which is nearest the salary or equal to that they held in the classification from which the Employee was transferred, whichever is greater, and their anniversary date shall be changed.
16.08 When an Employee is promoted from one classification to another the salary of such promoted Employee shall be advanced to that step in the new range which is next higher than their current rate of pay or to the step which is next higher again if such salary increase is less than the Employee's normal increment on the former salary range. The total amount of such payment shall not exceed the maximum Basic Rate of Pay of the higher paid classification in which the Employee is promoted. The anniversary date shall be changed to the first (1s of the month in which the promotion is effective.
16.09 The Employer shall provide to each new Employee a copy of their position description/ specifications, within fifteen (15) working days of commencement of employment. Trial Period
16.10 An Employee transferred or promoted to a more senior position in the Bargaining Unit requiring new or more progressed abilities or qualifications shall serve a two (2) month trial period of up to five hundred and five (505) hours worked in the new position. During the trial period the Employee may either:
(a) return to their former position at the Employee’s request, 's request if available; or
(b) be returned to their former position by the Employer; but in either circumstance, at the sole discretion of the Employeremployer, the Employee may be assigned to a similar position consistent with their abilities and/or qualifications, which position may not be in the same classification.

13.08 The salary of an Employee promoted and/or transferred to a higher classification shall be advanced at least to the start rate of the higher classification. Where the start rate of the higher classification is lower than the Employee’s request, if available; or
(b) 's existing rate the Employee's salary shall be returned advanced to their former position by the Employer; but in either circumstance, at the sole discretion next higher rate of the Employer, the Employee may be assigned to a similar position consistent with their abilities and/or qualifications, which position may not be in the same higher classification.
16.08 13.09 The foregoing Employer shall have the right to temporarily transfer Employees between classes at an equivalent or higher level or between facilities as the need arises. Such transfers shall not exceed two (2) weeks without the agreement of the Employees. Where work schedules allow, the Employer shall pay the Employees at straight-time rates to allow the Employee to return home for the weekend. Such transfers will first be offered on a voluntary basis. If that does not result in filling the necessary transfer, the Employer shall have the authority to assign the transfer. The Employer shall pay all reasonable living expenses (not to include personal entertainment).
13.10 The parties to this Collective Agreement affirm the Employer's right under Article 5 Management Recognition to manage the size of the workforce consistent with the provisions of the Agreement. However, it is further agreed that it is not the intention of the Employer that a Regular Full-Time Employee under Clause 1.01(b) be laid off for the purpose of replacing that Regular Full-Time Employee with a Temporary Employee as defined under Clause 1.01(c).

14.7. When an employee is demoted to, or successfully applies for a position in a lower pay category they shall be placed in that lower category at the step the employee is on just prior to assuming the position and five (505) hours worked there will be no change to the employee's anniversary date for annual increment purposes.
14.8. An employee who successfully applies for a position in a higher pay category or is reclassified to an equivalent or higher paid position shall be placed in the new position. During the trial period the Employee may either:
(a) return to their former position pay category at the Employee’s request, if available; or
(b) be returned step at least equal to their former position an amount represented by the Employer; but in either circumstance, at the sole discretion of the Employer, the Employee may be assigned to a similar position consistent with their abilities and/or qualifications, which position may not be one step in the same classificationemployee former pay category, with no change to the employee's anniversary date for annual increment purposes.
