Involuntary Transfer and Reassignment. 11.3.1 The District will consider volunteers before proceeding with an involuntary transfer or reassignment. A transfer or reassignment shall not be made arbitrarily, capriciously, or without basis of fact. 11.3.2 The Superintendent or designee shall give the affected bargaining unit member reasons in writing for the transfer or reassignment. 11.3.3 The bargaining unit member shall be given five (5) contract days notice of an involuntary transfer. The bargaining unit member to be involuntarily transferred or reassigned may request a meeting with the Superintendent within ten (10) days of receipt of the written reason(s).

Involuntary Transfer and Reassignment. 1 The Board and the Association recognize that some involuntary transfers and reassignment of Employees from one position or location to another is necessary. They also recognize that, under normal circumstances, involuntary transfer or reassignment of Employees should be held to a minimum; therefore, they agree as follows:
Involuntary Transfer and Reassignment. 1. When the Superintendent determines an involuntary transfer and/or reassignment is necessary, the bargaining unit member concerned shall be notified in writing of the transfer and the reason(s) for the transfer at the earliest date possible. Upon request, the member may meet with the Superintendent to discuss the reason(s) for the involuntary transfer or reassignment. 2. Should any vacancy occur in a building from which a bargaining unit member has been involuntarily transferred, that member may apply for the vacancy and shall be given priority consideration until the first duty day of the school year following the involuntary transfer, provided the member holds proper certification/licensure for the vacancy. A member's refusal to return to the first available position for which he/she is qualified would automatically terminate this option. 3. Involuntary transfers which occur because of staff reductions caused by declining enrollment or other personnel reductions in a program shall be in reverse order of seniority as defined in Article 17, Reduction in Force, unless the Superintendent determines that it is necessary to deviate there from because of the educational needs of students and the needs and interests of the school system. Involuntary transfers for other reasons shall not be subject to this provision. 4. No teacher will be involuntarily transferred into a position whose regular hours begin prior to “0” period or whose regular hours end after the end of the work day of the elementary school with the latest teacher dismissal time. It is understood that the teacher’s regular hours will be consecutive and not split into separate segments.

No employee will suffer a reduction in the hourly rate of pay or hours as a result of an involuntary transfer. e. Before involuntarily transferring an employee, the Superintendent or designee shall notify the Association President as to the reasons for the transfer and meet with the affected employee if so requested.

Involuntary Transfer and Reassignment. 13.3.1 Involuntary transfers or reassignments shall only be made for the following reasons: 13.3.1.1 A decrease in the number of students which requires a decrease in the number of Unit Members. 13.3.1.2 The elimination of program(s) or school closings which requires a decrease in the number of Unit Members. 13.3.1.3 As a means to resolve disputes between employees (See Problem Solving Procedures, Article 24, Section 6). 13.3.1.4 Other – for reasons of efficient operation of the District. 13.3.2 If a decrease in the number of students or the elimination of program(s) occurs, the District shall seek volunteers prior to making any involuntary transfer or reassignment. If an involuntary transfer or reassignment becomes necessary, the qualified Unit Member in the affected classification with the least seniority shall be transferred or reassigned.
Involuntary Transfer and Reassignment. A. Grounds for Involuntary Transfer or Reassignment 1. Involuntary transfers may occur for the current or forthcoming school term when the needs of the District, as determined by the Superintendent, require and for reassignment when the needs of the building, as determined by the principal, require. When possible, as determined by the Superintendent consistent with the needs of the District, the District will attempt to find volunteers before resorting to involuntary transfer. 2. A teacher is not considered to be an involuntary transfer if the position occupied by the teacher is reclaimed for the forthcoming school term by a teacher who is eligible to reclaim the position from a leave of absence, a limited-term assignment, or shared time. 3. Teachers assigned to districtwide programs will move with the class if the programs have to be relocated and shall not be considered involuntary transfers. B. Criteria for Selection When transfer or reassignment becomes necessary, minimum qualification requirements, a teacher's certifications and endorsements, academic focus, major and/or minor field of study, and continuous length of service in the District will be considered in determining which teacher is to be transferred or reassigned. C. Notice of Transfer or Reassignment 1. Notice of an involuntary transfer or reassignment for the coming school term shall be given to a teacher as soon as practicable. 2. An involuntary transfer or reassignment will be made only after a meeting is held between the teacher involved and the principal, at which time the teacher will be informed of the reasons for the transfer or reassignment which will, at the request of the teacher, be reduced to writing and placed in the teacher's personnel file. a. Involuntarily transferred teachers will be encouraged to apply for any positions in which they are interested. Involuntarily transferred teachers will inform the Human Resources Department of their assignment preferences. b. A secondary teacher, who is subject to being involuntarily transferred because of a reduction within a department, will be reassigned within the building if there is a position available in another department for which the teacher is minimally qualified. A teacher who declines such a reassignment will be considered a voluntary transfer. c. A teacher notified of involuntary reassignment shall be notified of positions available in his/her building and shall be considered before those seeking voluntary reassignments.
