Jobs and Skills (Contingency) Fund. 5.1 In the event that the annual key performance indicator monitoring undertaken under the Jobs and Skills Implementation Plan is agreed by a majority of the Jobs and Skills Engagement Group to indicate at year 2, and/or year 3 and/or year 4 and/or year 5 of the Construction Period that the Developer will not achieve the target of 2,000 (two thousand) Home Based Workforce members at Peak Construction: 5.1.1 The Jobs and Skills Engagement Group shall develop and agree a remedial action plan ("Jobs Action Plan") within 40 (forty) Working Days of the decision in paragraph 5.1 above the purpose of which is to achieve a minimum of 2,000 (two thousand) Home Based Workforce members at Peak Construction. 5.1.2 The Jobs Action Plan may include mitigation proposals for expenditure up to the maximum of the Jobs and Skills (Contingency) Fund, and in that case shall specify: (a) to whom the funding should be directed which may include the Council, Grŵp Llandrillo Menai, and/or other specialised training partners; and (b) the timing by which the Developer is required to release such funding. 5.1.3 The Jobs Action Plan may include other non-financial mitigation actions to be taken by members of the Jobs and Skills Engagement Group. 5.2 The Developer and the Council will comply with the mitigation proposals in the Jobs Action Plan and the Council shall apply the Jobs and Skills (Contingency) Fund in accordance with the Jobs Action Plan. 5.3 Release of funds from the Jobs and Skills (Contingency) Fund shall cease at the end of the Construction Period.

  • Recommended language skills The sending institution, following agreement with the receiving institution, is responsible for providing support to its nominated candidates so that they can have the recommended language skills at the start of the study or teaching period:

  • Bachelor’s Degree A four-year baccalaureate degree is recommended; however, applicants who complete a minimum of 90 semester or 135 quarter units of undergraduate study will qualify for admission. To be eligible to apply, the applicant must be on track to complete the required units through the summer term that precedes fall matriculation.

  • Degree A recognised degree from a higher education institution, often completed in three or four years, and sometimes combined with a one year diploma.

  • Agent’s Discretion Agent shall have the right in its sole discretion to determine which rights, Liens, security interests or remedies Agent may at any time pursue, relinquish, subordinate, or modify or to take any other action with respect thereto and such determination will not in any way modify or affect any of Agent’s or Lenders’ rights hereunder.

  • Lender’s Discretion Whenever pursuant to this Agreement, Lender exercises any right given to it to approve or disapprove, or any arrangement or term is to be satisfactory to Lender, the decision of Lender to approve or disapprove or to decide whether arrangements or terms are satisfactory or not satisfactory shall (except as is otherwise specifically herein provided) be in the sole discretion of Lender and shall be final and conclusive.

  • Master’s Degree Transcripts must be submitted showing the actual completion of the degree requirements, or a transcript plus certification that requirements have been met and the degree will be granted on a specific date. Master’s Degrees other than in the field of education are acceptable only if they are in or relevant to the member’s current subject area of teaching. Examples of degrees relevant to a member’s current subject area would be political science for social studies teachers, engineering for industrial arts teachers, reading, or counseling degrees for all teachers. Approval of degrees in areas other than the member’s current teaching assignment will be at the discretion of the District and will be granted based upon the program needs of the District. Specifically excluded are degrees in fields unrelated to the member’s assignment, such as business degrees for elementary teachers except in response to a specific District program need, and degrees in law and religion.

  • General Standard of Care The Custodian shall exercise reasonable care and diligence in carrying out all of its duties and obligations under this Agreement, and shall be liable to the Funds for all loss, damage and expense incurred or suffered by the Funds, resulting from the failure of the Custodian to exercise such reasonable care and diligence or from any other breach by the Custodian of the terms of this Agreement.

  • Headings Not Controlling 2.2.1 The headings and numbering of Sections, Parts, Appendices Schedules and Exhibits to this Agreement are for convenience only and shall not be construed to define or limit any of the terms herein or affect the meaning or interpretation of this Agreement. 2.2.2 This Agreement incorporates a number of Appendices which, together with their associated Attachments, Exhibits, Schedules and Addenda, constitute the entire Agreement between the Parties. In order to facilitate use and comprehension of the Agreement, the Appendices have been grouped under broad headings. It is understood that these groupings are for convenience of reference only, and are not intended to limit the applicability that any particular appendix, attachment, exhibit, schedule or addenda may otherwise have.

  • DTC Facility The Company shall cooperate with Manager and use its reasonable efforts to permit the Shares to be eligible for clearance and settlement through the facilities of DTC.
