Joint Occupational Health and Safety Committee. (a) The Hospital and the Association agree that they mutually desire to maintain standards of safety and health in the hospital in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Hospital agrees to accept as a member of its Joint Occupational Health and Safety Committee, at least one (1) representative selected or appointed by the Association from amongst bargaining unit employees. Hospitals with sites of up to one hundred (100) nurses per site may choose to include a representative from the bargaining unit from each site, or have a separate Joint Occupational Health and Safety Committee at each site or to remain with the current structure. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) The Hospital agrees to cooperate in providing necessary information to enable the Committee to fulfill its functions. In addition, the Hospital will provide the Committee with access to all accident reports, health and safety records and any other pertinent information in its possession. (e) Meetings shall be held every second month or more frequently at the call of the Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or selected in accordance with (b) hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. (j) At least one of the employees representing workers under the Occupational Health and Safety Act, who are trained to be certified workers as defined under the Act, shall be from the Association. The parties agree that it will not be a breach of this provision if only one employee representing workers is trained to be a certified worker and such employee is not from the Association provided that the next employee representing workers trained to be a certified worker is from the Association. (i) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee's physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the current contractual maternity leave. (j) Where OPTIONS identifies high-risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the nurses. (k) A member of a committee shall be deemed to be at work while the member is fulfilling the requirements for becoming a certified worker, and OPTIONS shall pay the member for the time spent at the member’s regular or premium rate as may be proper. ref: Occupational Health and Safety Act Sec.9 (36). Joint Occupational Health and Safety Committee. (j) A worker may refuse to work or do particular work where he or she has reason to believe that: i) any equipment, machine, device or thing the worker is to use or operate is likely to endanger himself, herself or another worker; ii) the physical condition of the workplace or the part thereof in which he or she works or is to work is likely to endanger himself or herself; or iii) any equipment, machine, device or thing he or she is to use or operate or the physical condition of the workplace or the part thereof in which he or she works or to work is in contravention of this Act or the regulations and such contravention is likely to endanger himself, herself or another worker. (k) The parties further agree that suitable subjects for discussion at the joint Labour Management Committee will include aggressive residents (l) The Home, in consultation with the JHSC, will develop, implement and amend as appropriate, policies, procedures, and programs, pertaining to the provision of a safe and healthy workplace. These shall include, but are not limited to: Violence in the Workplace Infection Prevention and Control Musculoskeletal Injury Prevention Safety Engineered Medical Sharps Early and Safe Return to Work The Home will provide copies of all such policies, procedures and programs pertaining to health and safety upon request. (m) The Employer will promptly investigate reports of workplace violence. This will include cases of attempted, threatened or actual conduct that causes or is likely to cause injury. It will also include any threatening statement or behaviour that gives a worker reasonable cause to believe that she/he or another worker is at risk of injury. In the course of its investigation, the Employer will prepare a written report outlining the circumstances of each incident, the evidence gathered, findings, any corrective action taken to prevent a recurrence, and provide this report to the Joint Health and Safety Committee and make this report available to affected workers.

Joint Occupational Health and Safety Committee. The parties agree that the intent of this agreement is to ensure that all employees shall have the maximum possible access to the Occupational Health and Safety Committee structure. The Occupational Health and Safety Committee will be established and operated as outlined below: (a) The Hospital Union representatives shall be employees at the workplace appointed by the Union, and the Association agree that they mutually desire to maintain standards of safety and health in the hospital in order to prevent accidents, injury and illnessemployer representatives shall be appointed by TSSI. (b) Recognizing its responsibilities under The Committee will function in accordance with the applicable legislationregulations made pursuant to the Workers Compensation Act, and will participate in developing a program to reduce risk of occupational injury and illness. All minutes of the Hospital agrees meetings of the Committee shall be recorded on a mutually agreed to accept as a member form and shall be sent to the Union and TSSI. (c) TSSI shall initiate and maintain, at the regular place of its Joint employment, an Occupational Health and Safety Committee, at least one Committee where there is: (1) representative selected a workforce of 25 or appointed more workers in an operation or work area classified as "C" (low) hazard by WCB First Aid Regulations. (2) Where employer workforce numbers are less than the Association from amongst bargaining unit employeesminimum requirements of (1), a committee may be established to encompass more than one worksite. Hospitals with sites of up Worksite combinations may be mutually agreed at the local level. Where mutual agreement cannot be reached at the local level, then either party may refer the matter to one hundred (100) nurses per site may choose to include a representative from the bargaining unit from each site, or have a separate Joint Occupational Health and Safety Committee at each site or to remain with established in Clause 22.2. (3) Notwithstanding (iii) above, the current structure. In additionshall not suffer any loss of basic pay for the time spent attending a committee meeting, the Hospital will provide the Committee job site inspection or accident investigation in accordance with access to all accident reports, health and safety records and any other pertinent information in its possessionWCB Regulations. (e) Meetings Committee meetings shall be scheduled during normal working hours whenever practicable. Time spent by designated committee members attending meetings held every second month on their days of rest or more frequently outside their regularly scheduled hours of work shall not be considered time worked, but such committee members shall receive equivalent time off at the call of the Chair, if required. Joint Occupational Health and Safety Committee. (f) Any representative appointed or selected in accordance with (b) hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. Time off for representatives . (g) The Union agrees to perform these duties endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (h) All time spent by a member of the Joint Occupational Health and Safety Committee attending meetings of the Committee and carrying out their duties, shall be granted. "A member of a committee is deemed to be work time for which they shall be paid by the Manor at their regular rate and they shall be entitled to, i) one hour or to such longer period of time from work as the committee determines is necessary to prepare attend scheduled meetings. (i) The parties will abide by the Occupational Health and Safety Act. (j) The parties agree that if incidents involving aggressive resident behaviours occur, such incidents will be recorded and reviewed by the Occupational Health and Safety Committee. Reasonable steps within the control of the Manor will follow to address the legitimate health and safety concerns of Nurses presented in that forum. The parties further agree that suitable subjects for each committee meeting;discussion at the joint Union - Management Committee will include recommendations from the Occupational Health and Safety Committee. It is understood that all such occurrences will be reviewed at the Resident Care Conference. (k) The Manor agrees to develop formalized policies and procedures in consultation with the Joint Health and Safety Committee to deal with workplace violence. The policy will address the prevention of violence and the management of violent situations and support to employees who have faced workplace violence. These policies and procedures shall be communicated to all employees. The local parties will consider appropriate measures and procedures in consultation with the Joint Health and Safety Committee to address violence in the workplace, which may include, among other measures and procedures: i) Alert employees about a person with a known history of aggressive and responsive behaviours and their known triggers by means of: A) electronic and/or other appropriate flagging systems B) direct verbal communication / alerts (i.e. shift reports) ii) Communicate and provide appropriate training and education, iii) Reporting all incidents of workplace violence and, iv) Long-term care home wide violence risk assessments. (l) When faced with occupational health and safety decisions, the Manor will not await full scientific or absolute certainty before taking reasonable action(s) including but not limited to, providing reasonably accessible personal protective equipment (PPE) that reduces risk and protects employees. i) The Manor will ensure there is an adequate supply of Pandemic PPE. The Manor will advise the JHSC the supply of Pandemic PPE on an annual basis and whenever they are required to advise the government. ii) The Manor will maintain a pandemic plan that will be shared annually with the JHSC.

(h) The parties agree that the following items are appropriate for discussion at committee meetings:  Proposed changes to diagnostic or medical machines and equipment that will impact the health and safety of employees;  The nature, content and duration of health and safety training programs for employees;  The use of personal protective equipment by employees; The committee may, in addition to the above, discuss other items relating to the health and safety of employees. (i) At committee meetings the Hospital shall provide the committee with a summary of all lost-time claims, health care claims, occupational disease claims, reports on accidents and critical or fatal injuries. In addition, all relevant government directives and orders shall be provided to the committee. The committee shall review this information and propose methods of reducing the number of injuries or accidents. (j) The committee shall participate in all inquiries and investigations pursuant to the Occupational Health and Safety act. The co-chairs* will determine the appropriate member or members who will participate in the investigation. If neither co-chair is available, the most appropriate committee member will be designated to participate in the investigation. In determining the appropriate member or members who will participate in the investigation, the parties recognize the interests of an OPSEU representative being involved in an investigation that involves an OPSEU bargaining unit member. *NOTE: If there is only one co-chair available, he or she will determine who will participate in the investigation.

Hospitals with sites of up to one hundred (100) nurses per site may choose to include a representative from the bargaining unit from each site, or have a separate Joint Occupational Health and Safety Committee at each site or to remain with the current structure. Hospitals with sites of over one hundred (100) nurses per site will choose either to include a representative from the bargaining unit from each site, or to have a separate Joint Occupational Health and Safety Committee at each site, unless the parties agree otherwise. (cb) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs programmes and recommend actions to be taken to improve conditions related to safety and health. (c) It is understood that consultation on issues of mutual concern will occur between the Joint Health and Safety Committee and Infection Control. d) The Hospital agrees to cooperate co-operate in providing necessary information to enable the Committee to fulfill fulfil its functions. In addition, the Hospital will provide the Committee with access to all accident reports, health and safety records and any other pertinent information in its possession. (e) Meetings shall be held every second month or more frequently at the call of the Chaira co-chair, if requiredwhen requested. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or selected in accordance with (bArticle 28.07(a) hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. Time off for representatives such representative(s) to perform these duties attend meetings of the Joint Health and Safety committee in accordance with the foregoing, shall be granted. "A member of a committee is entitled to, : i) one (1) hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting; ii) such time as is necessary to attend meetings of the committee; and iii) such time as is necessary to carry out inspections and investigations contemplated under subsection 9(27.), 9(27), and 9(31) of the Occupational Health and Safety Act R.S.O. 1990 as amended up to and including 1998. A member of a committee shall be deemed to be at work during the times described above and the Hospital shall pay the member for those times at the member’s regular or premium rate as may be proper. g) The Hospital will ensure that there is one (1) OPSEU member certified, as described in the Occupational Health and Safety Act R.S.O. 1990, as amended up to and including 1998 among the OPSEU bargaining unit(s) at the Hospital. Such member on the committee will be selected or appointed by the Union. All issues relating to salary and costs associated with obtaining certification shall be in accordance with Article 14.10. h) The parties agree that the following items are appropriate for discussion at committee meetings: • Proposed changes to diagnostic or medical machines and equipment that will impact the health and safety of employees; • The nature, content and duration of health and safety training programs for employees; • The use of personal protective equipment by employees; The committee may, in addition to the above, discuss other items relating to the health and safety of employees. i) At committee meetings the Hospital shall provide the committee with a summary of all lost-time claims, health care claims, occupational disease claims, reports on accidents and critical or fatal injuries. In addition, all relevant government directives and orders shall be provided to the committee. The committee shall review this information and propose methods of reducing the number of injuries or accidents. j) The committee shall participate in all inquiries and investigations pursuant to the Occupational Health and Safety act. The co-chairs* will determine the appropriate member or members who will participate in the investigation. If neither co-chair is available, the most appropriate committee member will be designated to participate in the investigation. In determining the appropriate member or members who will participate in the investigation, the parties recognize the interests of an OPSEU representative being involved in an investigation that involves an OPSEU bargaining unit member. *NOTE: If there is only one co-chair available, he or she will determine who will participate in the investigation.
