Joint Occupational Health and Safety Committee. The Employer and the Union recognize the role of the joint Occupational Health and Safety Committee in promoting a safe and healthful workplace. Every effort will be made to schedule committee meetings, workplace inspections and accident investigations during the committee members’ scheduled working hours. All minutes of the meetings of the Joint Occupational Health & Safety Committee will be recorded in a mutually agreeable format and will be sent to the Union. The Employer agrees to provide or cause to be provided to Employer members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfill those duties competently. The Union agrees to provide or cause to be provided to Union members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfill those duties competently. Such training and orientation shall take place within six (6) months of taking office.

Joint Occupational Health and Safety Committee. (e) Meetings shall be held every second [2nd] month or more frequently at the call of the Chair, if required. The Committee shall govern itself maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or selected in accordance with (b) hereof, shall serve for a term of at least one (1) calendar year from the provisions date of the Industrial Health and Safety Regulations made pursuant appointment. (i) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee's physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the current contractual maternity leave. (j) Where the Home identifies high risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the duties nurses. The Home will keep adequate stocks of the N95 respirator to be made available to nurses in the event the Joint Occupational Health and responsibilities Safety Committee concludes that there are reasonable indications of committee members the emergence of a pandemic. (k) The Home agrees that it will recommend to allow the incumbents Health and Safety Committee to fulfill those duties competently. The parties agree that if actions by aggressive residents result in accordance with injury to an Employee, and/or lead to the provisions filing of an Incident Report, such Report will be provided to the Industrial Joint Occupational – Health and Safety Regulations made pursuant to Committee for review. Scheduled time spent in obtaining the workers certification by the JOH&S representative of ONA shall be paid by the Employer at the nurses regular rate of pay. v) The Home agrees to cooperate in providing necessary information to enable the joint occupational health and orientation safety committee to fulfil its functions. The Home will provide the committee with access to all accident reports, health and safety records which the Employer may have in its possession. vi) The Union shall endeavour to obtain the full co-operation of its membership in the compliance of all safety rules and practices. The Employer and the Nurses recognize their obligations to ensure compliance and enforcement as defined by the Occupational Health and Safety Act. Where in the view of the nurse a possible infraction under the OH&S Act or the OH&S Employer policies are not being followed, the nurse shall have the authority to, in a timely manner, report such to the duties and responsibilities Employer. ONA will provide the Corporation with a list of committee members to allow the incumbents to fulfill those duties competently. The Union agrees to provide or cause to be provided to Union members of the its Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfill those duties competentlyrepresentatives. Such training and orientation shall take place within six (6) months of taking officeThis list will be revised when changes occur.

Representatives of the Union shall be chosen by the Union membership or appointed by the Union. The Union agrees these provisions shall be construed to require a single JOSH committee for the Employer’s operations. Where the Joint Occupational Health and Safety Committee is conducting an accident investigation involving a member, the OH&S representative designated shall be involved where it does not delay the investigation. The Employer will encourage the expanded OH&S knowledge and skill base of all OH&S committee members. Such measures may include in-services, courses offered by external agencies, video training and printed matter. The Employer will encourage managers to actively participate as members on their respective OH&S committees. The Union will continue to encourage its members to actively participate on OH&S committees

Unless mutually agreed to otherwise, the Committee shall be established. consist of two union representatives, from the Road Crew, Mechanical Crew or Bridge Crew, and two management representatives. (b) The Committee shall govern itself Committees will function in accordance with the provisions of the Industrial Occupational Health and Safety Regulations made pursuant to the Workers' Workers Compensation Act. Representatives of the Union shall be chosen by the Union membership or appointed by the Union. The Union agrees these provisions shall be construed to require a single JOSH committee for the Employer’s operations. The employee member(s) of the Committee shall be granted leave without loss of pay or receive straight time regular wages while attending meetings of the joint committee. The member(s) of the Committee shall be granted leave without loss of pay or receive straight time regular wages to , and will participate in workplace inspections developing a program to reduce risk of occupational injury and accident investigations at the request of the Committee pursuant to the Occupational Health and Safety Regulations. Every effort will be made to schedule committee meetings, workplace inspections and accident investigations during the committee members’ scheduled working hoursillness. All minutes of the meetings of the Joint Occupational Health & Safety Committee will committees shall be recorded in on a mutually agreeable format agreed to form and will shall be sent to the UnionUnion and the Employer. (c) Employees who are representatives of the Committee shall not suffer any loss of current pay for the time spent attending a committee meeting, job site inspection or accident investigation in accordance with WCB Regulations. Transportation shall be provided by the Employer. (d) Committee meetings shall be scheduled during normal working hours whenever practicable. Time spent by designated committee members attending meetings held on their days of rest or outside their regularly scheduled hours of work shall not be considered time worked but such committee members shall receive equivalent time off at straight-time. (e) Other committee business in accordance with (c) above shall be scheduled during normal working hours whenever practicable. When no other union designated committee member or union designated employee is available, time spent by employees attending to this committee business on their days of rest or outside their regularly scheduled hours of work shall not be considered time worked but such employees shall receive equivalent time off at straight-time. (f) The Employer and the Union agree that it is mutually beneficial to have all members in attendance at meetings of health and safety committees. The Employer agrees shall make every reasonable effort to provide or cause ensure that the union members are able to be provided attend such meetings. (g) An employee who serves on a health and safety committee and who is designated to Employer members investigate matters pertaining to safety and health during their normal working hours shall receive the rate of the Joint Occupational Health pay they would normally earn if they were not serving on these committees. (h) The health and Safety Committee adequate training and orientation safety committee may refer unresolved issues to the duties and responsibilities of joint labour management committee members for possible resolution. This provision does not limit any right to allow the incumbents to fulfill those duties competently. The Union agrees to provide or cause to be provided to Union members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfill those duties competently. Such training and orientation shall take place within six (6) months of taking officeseek a resolution from WorkSafeBC.

(g) The Joint Health and Safety Committee will discuss and may recommend appropriate measures to promote health and safety in workplaces, including, but not limited to: ▪ Musculoskeletal Injury Prevention ▪ Needle Stick Injury Prevention ▪ Personal Protective Equipment ▪ Training designed to ensure competency under the duties and responsibilities of committee members to allow the incumbents to fulfill Act for those duties competently. Such training and orientation shall take place within six (6) months of taking officepersons with supervisory responsibilities.

The Committee shall govern itself in accordance with the provisions of the Industrial Health and Safety Regulations made pursuant to the Workers' Compensation Act. Representatives of the Union shall be chosen by the Union membership Committee, at least one (1) representative selected or appointed by the UnionUnion from amongst bargaining unit employees. (f) Any representative appointed or selected in accordance with (b) hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. Time off for representatives to perform these duties shall be granted. The Union agrees to provide or cause to be provided to Union members of the Joint Occupational Health industrial health and Safety Committee adequate training safety matters and orientation recommend their implementation to the duties and responsibilities of committee members to allow the incumbents to fulfill those duties competently. Such training and orientation shall take place within six Employer, where warranted; (6) months hold regular meetings in accordance with Section (a) for the review of: (i) reports of taking officecurrent accidents or industrial diseases, their causes and means of prevention; (ii) remedial action taken or required by the reports of investigations and inspections; and (iii) any other matters pertinent to industrial health and safety.

The Home will provide the committee with access to all accident reports, health and safety records which the Employer may have in its possession. vi) The Union agrees shall endeavour to provide or cause obtain the full co-operation of its membership in the compliance of all safety rules and practices. The Employer and the Nurses recognize their obligations to be provided to Union members of ensure compliance and enforcement as defined by the Joint Occupational Health and Safety Committee adequate training and orientation Act. Where in the view of the nurse a possible infraction under the OH&S Act or the OH&S Employer policies are not being followed, the nurse shall have the authority to, in a timely manner, report such to the duties and responsibilities Employer. The Employer Hospital and the Union recognize Association agree that they mutually desire to maintain standards of safety and health in the role hospital in order to prevent accidents, injury and illness. its responsibilities under the applicable legislation, the Hospital agrees to accept as a member of the joint its Joint Occupational Health and Safety Committee, at least one representative selected or appointed by the Association from amongst bargaining unit employees. Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. The Hospital agrees cooperate in promoting providing necessary information to enable the Committee to its functions. In addition, the Hospital will provide the Committee with access to all accident reports, health and safety records and any other pertinent information in its possession. Meetings shall be held every second month or more frequently at the call of the Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review. representative appointed or selected in accordance with hereof, shall serve for a safe term of at least one calendar year from the date of appointment. Time off for representatives to perform these duties shall be granted. such time as is necessary to attend meetings of the committee; and healthful workplacesuch time as is necessary to carry out [inspections and investigations under subsection 9 9 and 9 of the occupational Health and Safety Act, Sec. 9 member of a committee shall be deemed to be at work during the times described [above] and the member's employer shall pay the member for those times at the member's regular or premium rate as may be proper." ref. Where the Hospital identifies high risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the nurses. At least one of the employees representing workers under the Occupational Health and Safety Act, who are trained to be certified workers as defined under the Act, shall be from the Association. The Hospital agrees to give representatives of the Ontario Nurses' Association access to the duties and responsibilities premises of committee members the Hospital for the purpose of attending grievance meetings or otherwise assisting in the administration of this Agreement, provided prior arrangements are made with the Administrator. Such representatives shall have access to allow the incumbents premises only with the approval of the Administrator which will not be unreasonably withheld. Where a nurse makes prior arrangements for time off from a tour of duty, the nurse shall be scheduled to fulfill those duties competentlywork another tour that day. The Union agrees to provide or cause to be provided to Union Nurses who are members of committees pursuant to Regulation of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities Public Hospitals Act will suffer no loss of earnings for time spent during regular working hours for attending committee members to allow the incumbents to fulfill those duties competentlymeetings. This will include participating in joint workplace inspections and joint accident investigations at the request of the XXXX Committee pursuant to the Occupational Health and Safety RegulationsRegulation. Every effort will be made to schedule committee Committee meetings, workplace inspections inspections, and accident investigations will be scheduled during normal working hours whenever practicable. (c) The XXXX Committee will have as part of its mandate the committee members’ scheduled working hoursjurisdiction to receive complaints or concerns regarding workload problems that are safety-related, the right to investigate such complaints, the right to define the problem, and the right to make recommendations for a solution. Within 21 days thereafter, the Employer will advise the XXXX Committee what steps it has taken or proposes to take to rectify the safety-related workload problem identified by the XXXX Committee. (d) The XXXX Committee may use the resources of the meetings Workers' Compensation Board and/or other sources to provide information to the JOHS Committee members in relation to their roles and responsibilities. (e) The XXXX Committee will assist in increasing the awareness of all staff on such topics as: workplace safety, safe lifting techniques, dealing with aggressive residents, WHMIS, and the role and function of the Joint Occupational Health & Safety XXXX Committee. The JOHS Committee will be recorded assist in a mutually agreeable format fostering knowledge of and will be sent to compliance with the Union. The Employer agrees to provide or cause to be provided to Employer members of the Joint Occupational Health and Safety Regulation by all staff. (f) The Employer, in consultation with the XXXX Committee, will institute a written procedure for checking the well-being of employees assigned to work alone or in isolation under conditions which present a risk of disabling injury, if the employee might not be able to secure assistance in the event of injury or other misfortune. This procedure will be reviewed by the XXXX Committee, and the XXXX Committee adequate training and orientation may make recommendations to the duties Employer, as it deems necessary. (g) The Employer will promote processes that provide the most effective ways to safely perform work. These processes will include consideration of safety measures such as timely risk assessment tools, environmental ergonomic adjustments, care design and responsibilities redesign for residents, sufficient staffing, and training/team meetings (such training/team meetings will be considered training under Clause 19.3 (Scheduled Training)). This will include identifying factors in the workplace that may expose workers to a risk of committee members musculoskeletal injury (MSI), assessing any such risk, and eliminating or, if that is not practicable, minimizing the risk of MSI to allow the incumbents to fulfill those duties competentlyemployees. The Union agrees JOHS Committee will have as part of its mandate the jurisdiction to provide or cause make recommendations on these measures, supported by available resources (e.g., from WCB). (h) The XXXX Committee may make recommendations on ergonomic adjustments and on measures to be provided to Union protect pregnant employees as far as occupational health and safety matters are concerned. (i) As required by the Workers Compensation Act, employees who are members of the Joint JOHS Committee will be entitled to leave to attend OHS training which will be considered training under Clause 19.3 (Scheduled Training). The Employer will pay for, or reimburse the employee for, the cost of the training. (j) The Employer will consult with the Union when making a proposal to WCB for any variation to XXXX Committee requirements under the Workers Compensation Act. (k) Occupational Health health and Safety safety will include both physical and psychological health and safety. (l) The XXXX Committee adequate training may request from the Employer information that it considers necessary to identify workplace hazards and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfill those duties competentlymake recommendations. Such training information will be provided in a timely manner and orientation shall take place within six (6) months of taking officewill not be unreasonably withheld.

Joint Occupational Health and Safety Committee. ‌ a) The Employer and the Union recognize agree to establish a Joint Occupational Health and Safety Committee. The composition will be determined locally through management and local Union representatives. The committee shall schedule monthly meetings to make recommendations on unsafe, hazardous or dangerous conditions with the role aim of preventing and reducing risk of occupational injury and illness. A copy of all minutes of the joint Joint Occupational Health and Safety Committee in promoting a safe shall be sent to the Union and healthful workplacethe Employer. b) The Joint Occupational Health and Safety Committee shall be notified of each accident or injury. The parties agree that Committee shall investigate, as specified by the Workers Compensation Act and Regulations and WorkSafeBC, and report to the Union and Employer on the nature and cause of the accident or injury. c) An employee who serves on a Joint Occupational Health and Safety Committee shall be established. The Committee shall govern itself in accordance with the provisions of the Industrial Health and Safety Regulations made pursuant to the Workers' Compensation Act. Representatives of the Union shall be chosen by the Union membership or appointed by the Union. The Union agrees these provisions shall be construed to require a single JOSH committee for the Employer’s operations. The employee member(s) of the Committee shall be granted leave without loss receive their regular rate of pay or receive straight time regular wages while for attending meetings of the joint committee.
