Common use of Jury and Subpoena Leave Clause in Contracts

Jury and Subpoena Leave. Leave of absence with pay will be granted for jury duty and/or when an employee has been subpoenaed to appear in a court of law in his/her capacity as an employee of the District. The employee will notify the District when notified to serve on jury duty or when so served with a subpoena. Any compensation received by the employee for services performed applicable under this section on and during contracted days will be deducted from the employee's salary, less documented expenses incurred in fulfilling such service. Jury/Subpoena leave will not be deducted from an employee's sick leave. If an employee is named as a co-defendant with or a witness for the District in a court action, the provisions of this section will apply. If the employee is the plaintiff against the District, this section will not apply and the employee must use leave without pay.
