Common use of Leave Without Pay Without Right of Return Clause in Contracts

Leave Without Pay Without Right of Return. If leave without pay without right of return is granted, after such leave, the employee shall have no entitlement to return to the same class in the same department as he/she occupied at the commencement of the leave. The Director, Department of Human Resources, may, with proper justification, grant a leave without pay without right to return for a maximum of twenty-six (26) biweekly pay periods. At the expiration of this leave, if an employee is not offered an opportunity to return to the same class in the same department, the employee shall be deemed to be absent without leave.
