LEGAL WORK DAY. With limited exceptions Contractor and Contractor’s subcontractor(s) shall not permit any person performing any of the Work to work more than eight (8) hours during any one (1) calendar day or more than forty (40) hours during any one (1) calendar week. Contractor and Contractor’s subcontractor(s) shall forfeit, as a penalty to District, Twenty-Five Dollars ($25.00) for each worker employed in the performance of the Work by Contractor or Contractor’s subcontractor(s) who is required or permitted to work more than eight (8) hours in any one (1) calendar day or forty (40) hours in any calendar week in violation of Labor Code Sections 1810 through 1815. Notwithstanding the foregoing, in accordance with Labor Code Section 1815, Contractor and Contractor’s subcontractor(s) may permit a worker to work in excess of eight (8) hours per day, or forty (40) hours per week, if all work in excess of such limits is compensated at a rate not less than one and one-half (1½) times the worker’s basic rate of pay.

LEGAL WORK DAY. Eight (8) hours labor constitutes a legal day’s work performed pursuant to this Contract. The Contractor shall forfeit as a penalty to COUNTY TWENTY- FIVE DOLLARS ($25.00) for each xxxxxxx employed in the execution of the Contract by the Contractor or by any subcontractor for each calendar day during which such xxxxxxx is required or permitted to work more than eight (8) hours in any one (1) calendar day and forty (40) hours in any one (1) calendar week in violation of Division 2. Part 7, Chapter 1, Article 3, of the Labor Code (Labor Code Section 1810-1815). Notwithstanding the foregoing provisions of this Section, work performed by employees of Contractors and of subcontractors in excess of eight (8) hours per day and forty (40) hours in any one (1) week shall be permitted upon compensation for all hours worked in excess of eight (8) hours a day at not less than one and one half (1-1/2) times the basic rate of pay.

APPRENTICES. Contractor and Contractor’s subcontractor(s) shall be responsible for compliance with the provisions of law relating to employment of apprentices, including Labor Code Sections 1777.5, 1777.6, and 1777.7. Pursuant to Labor Code Section 1777.7, violations of Labor Code Section 1777.5 may result in forfeiture not to exceed One Hundred Dollars ($100.00) for each full calendar day of non-compliance. Information regarding apprenticeship standards, wage schedules, and other requirements may be obtained from the DIR or from the Division of Apprenticeship Standards of the DIR.
