WORK BY CONTRACTOR. 3.4.1 All portions of the Work on the Project shall be performed by the lowest responsible and responsive bidder under Subcontracts with the Contractor. The Contractor shall request and receive sealed proposals from Subcontractors and Subcontracts will be awarded after the proposals are reviewed by the Architect, the Contractor and the Owner and approved by the Owner. The Contractor may submit a sealed proposal for any portion of the Work. The proposals shall include the amount of profit and overhead that the Subcontractor would require on Change Orders. The Contractor shall furnish to the Owner copies of Notices of Award and of all Subcontracts, fully executed, within one (1) week after execution. 3.4.2 If the Owner refuses to accept a Subcontractor recommended by the Contractor, the Contractor shall recommend an acceptable substitute and the Guaranteed Maximum Price, if applicable, shall be increased or decreased by the difference in cost occasioned by such substitution and an appropriate Change Order shall be issued.

The contractor shall haul and remove all construction debris daily. 6. The contractor shall satisfy all requirements prescribed by the Code of Ordinances of the Town of Dundee and/or Town of Dundee Land Development Code which includes, but shall not be limited to, obtaining all necessary approvals prior to mobilization.

  • Claim by Contractor After receipt of the Notice of Termination from the state, the Contractor shall submit any claim for additional costs not covered herein or elsewhere in the Contract within 60 days of the effective termination date, and not thereafter. Should the Contractor fail to submit a claim within the 60-day period, the State may, at its sole discretion, based on information available to it, determine what, if any, compensation is due the Contractor and pay the Contractor the determined amount.

  • By Contractor Should the Contractor be liable for any payments to the State hereunder, interest, late payment charges and collection fee charges will be determined and assessed pursuant to Section 18 of the State Finance Law.
