Common use of LEGISLATION AND THE COLLECTIVE AGREEMENT Clause in Contracts

LEGISLATION AND THE COLLECTIVE AGREEMENT. In the event that any law passed by the Legislature of the Province applying to employees covered by this Agreement, renders null and void or materially alters any provision of this Agreement, the remaining provisions of the Agreement shall remain in effect for the term of this Agreement, and the parties to this Agreement shall negotiate where applicable a mutually agreeable provision to be substituted for the provision so rendered null and void or materially altered. Where any provincial legislation which binds the parties to this Agreement clearly specifies and directs that greater rights or benefits than are in effect under this Agreement must be granted to either party, such rights or benefits shall be deemed to form part of and be applicable under this Agreement.
