Common use of Level Four - Arbitration Clause in Contracts

Level Four - Arbitration. a. If the aggrieved person is not satisfied with the disposition of his/her grievance at Level Three or if no decision has been rendered within ten (10) school days after the grievance was delivered to the Board, he/she may, within five (5) days after the grievance was delivered to the Board, whichever is sooner, request in writing that the Association submit its grievance to arbitration. If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration within fifteen (15) school days after receipt of a request by the aggrieved person.

Level Four - Arbitration. a. If the aggrieved person is not satisfied with the disposition of his/her grievance at Level Three 3, or if no decision has been rendered within ten (10) school days after the grievance was delivered to the BoardBoard of Education, he/she may, within five (5) school days after the decision by the Board of Education or fifteen (15) school days after the grievance was delivered to the Board, whichever is sooner, request in writing that the Association A.R.E.A. submit its grievance to arbitration. If the Association A.R.E.A. determines that the grievance is meritorious, it may submit the grievance to arbitration within fifteen (15) school days after receipt of a request by the aggrieved person.

If the aggrieved person is not satisfied with the disposition of his/her his grievance at Level Three or if no decision has been rendered within ten fourteen (1014) school days after the grievance was delivered to the Board, he/she he may, within five (5) school days after the grievance was delivered to the Board, whichever is sooner, request re- quest in writing that the Association submit its grievance to arbitration. If the Association theAssociation determines that the grievance is meritorious, it may submit the grievance to arbitration within fifteen (15) school days after receipt of a request by the aggrieved person.

If the aggrieved person is not satisfied with the disposition of his/her his grievance at Level Three Three, or if no decision has been rendered within ten five (105) school working days after the grievance was delivered to the School Board, he/she he may, within five (5) working days after a decision by the School Board or five (5) working days after grievance was delivered to the School Board, whichever is sooner, request in writing that the Association submit its grievance to arbitration. If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration within fifteen five (155) school working days after receipt of a request by the aggrieved person.

If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration within fifteen (15) school days after receipt of a request by the aggrieved person.

If the aggrieved person person(s) or the Association is not satisfied with the disposition of his/her grievance at Level Three Three, or if the Board has rendered no decision has been rendered within twenty (20) school days, the aggrieved person(s) or the Association may within ten (10) school days after the grievance was delivered to the Boarddays, he/she may, within five (5) days after the grievance was delivered to the Board, whichever is sooner, request in writing that the Association submit its grievance to arbitration. If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration within fifteen (15) school days after receipt of a request by the aggrieved personarbitration.
