Common use of Level Four - Arbitration Clause in Contracts

Level Four - Arbitration. (a) If the aggrieved person is not satisfied with the disposition of the grievance of Level Three, or if no decision has been rendered within ten (10) school days after the grievance was delivered to the Board, the Teacher may, within five (5) school days after a decision by the Board or fifteen (15) school days after the grievance was delivered to the Board, whichever is sooner, request in writing that the Association submit its grievance to arbitration. If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration within fifteen (15) school days after a receipt of a request by the aggrieved person.

Level Four - Arbitration. (a) If the aggrieved person is not satisfied with the disposition of the grievance of at Level Three, or if no decision has been rendered within ten (10) school days after the grievance was delivered to the BoardPresident of the Board of Education, the Teacher member may, within five (5) school days after a decision by the Board of Education or fifteen (15) school days after the grievance was delivered to the BoardPresident of the Board of Education, whichever is sooner, request in writing that the Association submit its grievance to arbitration. If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration within with fifteen (15) school days after a receipt of a request by the aggrieved person.

If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration within fifteen (15) school days after a receipt of a request by the aggrieved person.

If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration within fifteen (15) school days after a receipt of a request by the aggrieved person.

Level Four - Arbitration. (a) If the aggrieved person is not satisfied with the disposition of the grievance of at Level Three, or if no decision has been rendered within ten (10) school days after the grievance was delivered to the President of the Board, the Teacher member may, within five (5) school days after a decision by the Board or fifteen (15) school days after the grievance was delivered to the President of the Board, whichever is sooner, request in writing that the Association submit its grievance to arbitration. If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration within with fifteen (15) school days after a receipt of a request by the aggrieved person.

(a) If the aggrieved person is not satisfied with the disposition of the his grievance of at Level Three, or if no decision has been rendered within ten five (105) school days after the grievance was delivered to the BoardBoard of School Directors, the Teacher may, he may within five (5) school days after a decision by the Board of Directors or fifteen (15) school days after the grievance was delivered to the BoardBoard of School Directors, whichever is sooner, request in writing that the Association Union submit its grievance to of arbitration. If the Association determines that the grievance is meritoriousUnion desires, it may submit the grievance to arbitration within fifteen (15) school days after a the receipt of a request by the aggrieved person.

Level Four - Arbitration. (a) If the aggrieved person is not satisfied with the disposition of the his/her grievance of at Level Three, Three or if no decision has been rendered within ten (10) thirty school days after the grievance was delivered to the Board, the Teacher may, he/she may within five (5) school days after a decision by the Board or fifteen (15) thirty-five school days after the grievance was delivered to the Board, whichever is sooner, he/she file a written request in writing that with the Association to submit its the grievance to arbitrationArbitration. If the Association determines that the grievance is meritorious, it may submit the grievance to arbitration be meritorious, the Association may, within fifteen (15) ten school days after from the date of the grievant’s appeal, submit a receipt written request to the Superintendent requesting arbitration of a request by the aggrieved persongrievance. Grievances concerning the following items shall not be deemed to be arbitrable.

The Association shall notify the employer in writing that it has submitted the grievance to arbitration within five (5) school days after said grievance is submitted to arbitration.
