Licensing and Certification. 1. With a view to ensuring that any measure adopted ormaintained by a Party relating to the licensing,certification, or technical standards of service suppliersof the other Party does not constitute an unnecessarybarrier to cross-border trade in services, each Party shallendeavor to ensure that such measure: (a) is based on objective and transparent criteria,such as competence and the ability to supply theservices; (b) is not more burdensome than necessary to ensurethe quality of the services; and (c) does not constitute a disguised restriction onthe cross-border supply of the services. 2. Where a Party recognizes, unilaterally or byagreement, education, experience, licenses orcertifications obtained in a non-Party, nothing in Article 99 shall be construed to require the Party to accord suchrecognition to education, experience, licenses orcertifications obtained in the other Party.
