Limited License to Customer Data. 9.1 Customer grants SISW a worldwide, non-exclusive, transferable, royalty-free license to use, host, transmit, display, sublicense as necessary for SISW to fulfill its obligations under this Agreement, and reproduce all Customer Data. Customer will indemnify and defend, at its expense, any action brought against SISW to the extent that it is based upon a claim that the Customer Data infringes a patent, copyright, trade secret or other intellectual property right and will pay all costs and damages finally awarded against SISW by a court of competent jurisdiction, provided that Customer is given prompt written notice of such claim and is given information, reasonable assistance, and sole authority to defend or settle the claim. Customer shall not enter into any settlement admitting liability or incurring obligations on behalf of SISW, without SISW’s prior written consent.
Limited License to Customer Data. 11.1 Subject to the terms and conditions of this Agreement, Customer grants to PSNI a non- exclusive license to use, copy, store, transmit and display Customer Data to the extent reasonably necessary to provide and maintain the Service.

Subject to the terms and conditions of this Agreement, Customer grants to Materialise, its affiliates and applicable contractors a world-wide, royalty free, perpetual, irrevocable, and non-exclusive license to use, distribute, reproduce, modify, and display the Customer Data on an aggregated, anonymous basis to (i) evaluate and provide benchmarking, analytics and trends for Customer, Materialise, third parties and its other customers and (ii) to improve the Software and associated services. Except for the limited license granted herein, no rights in Customer Data are granted to Materialise under this Agreement. Customer grants to Materialise and its affiliates a world-wide, royalty free, perpetual, irrevocable, and non-exclusive license to use and incorporate into Materialise’s and/or its affiliates’ services any suggestion, enhancement request, recommendation, correction or other Feedback provided by Customer relating to the operation of the Software or Materialise’s services.

Subject to the terms and conditions of this Agreement, Customer grants to Apica and its affiliates a non-exclusive license to use, copy, store, transmit and display use technical information, excluding any Confidential Information, and Customer Data to the extent reasonably necessary to provide and maintain the Service. Apica may disclose this information, excluding the Customer’s identity and other information specific to the Customer, to others but not in a form that personally identifies Customer.

The Customer grants SurveyMonkey a worldwide, royalty-free license to use, reproduce, distribute, modify, adapt, create derivative works, make publicly available, and otherwise exploit Customer Data, but only for the limited purposes of providing the Services and Professional Services to the Customer and as otherwise permitted by SurveyMonkey’s privacy policies. This license for such limited purposes continues even after this Agreement or the applicable Sales Document terminates with respect to aggregate and de- identified data derived from Customer Data and any residual backup copies of Customer Data made in the ordinary course of business. This license also extends to any trusted third parties that SurveyMonkey works with to the extent necessary to provide the Services to the Customer. If the Customer provides SurveyMonkey with feedback about the Services, SurveyMonkey may use that feedback without any obligation to the Customer.
