LISTED BUILDING CONSENT. (‘THE CONSENTED WORKS’) 4.1 Listed Building Consent is hereby given for the works described in Section 4 to Stow Maries Great War Aerodrome. The Consent is subject to the following Conditions: 4.2 The works hereby permitted must be begun before the expiration of the five years from the date of the most recent review of the LBHPA. 4.3 Before any works are begun written notification of the intended start of the works is to be submitted to the Council by the appointed architects Trust to the Council’s Conservation Officer giving two weeks’ notice. Thereafter updates shall be provided by the Trust via a monthly email to all parties to the LBHPA, with on-site meetings as necessary. All works that fall within the remit of the HPA must be notified to the parties, whether they are part of a wider contract/project or not. Updates must continue for the life of the agreement. 4.4 The consented works shall not commence for any particular building until a full and up to date record of that building has been made in the Gazeteer (Appendix F) and approved by the Council’s Conservation Officer. A full record shall comprise a written summary accompanied by annotated photographs (including rectified photographs where appropriate) explaining the chronology of the building’s development including the dating of repairs, alterations, features and fittings. 4.4.1 Appendix G, the Repair Spreadsheets, shall be kept up to date. 4.5 All work to the buildings shall be in accordance with the specification hereby approved in writing by the Council and Historic England and attached in Appendix E and as evidenced in Appendix F and scheduled in Appendix G. 4.6 Works to walls 4.6.1 The removal of cementitious pointing where it is damaging the brickwork and can be removed without causing additional damage – provided the removal affects no more than 60% of the elevation affected. 4.6.2 Sound cementitious pointing should be left in situ 4.6.3 Re-pointing using an approved lime mortar according to the specification in Appendix E and as evidenced in Appendix F and scheduled in Appendix G – provided the re-pointing affects no more than 60% of the elevation affected. 4.6.4 Replacement of linear steel binders embedded in mortar where it is damaging the brickwork, or their treatment and stabilisation as defined in the specification in Appendix E and as evidenced in Appendix F and scheduled in Appendix G 4.6.5 Patch repair of shuttered concrete walls as defined in the specification in Appendix E and...

Thereafter a monthly update of works undertaken and works planned shall be submitted by the Site Manager to the Council’s Conservation Officer on the first Monday of each month by email. 4.4 The consented works shall not commence for any particular building until a full record of that building has been made and approved. 4.5 All work to the buildings shall be in accordance with the specification hereby approved in writing by the Council and English Heritage and attached in Appendix E.
LISTED BUILDING CONSENT. Subject to annual review and agreement, Historic Environment Scotland does not intend to provide detailed advice on applications for Listed Building Consent for the following types of application with Dumfries and Xxxxxxxx Council area. This does not infer that Historic Environment Scotland considers that these types of work are not significant, but recognises that Dumfries and Xxxxxxxx Council has appropriate policies in place and sufficient access to expertise.   • Maintenance Repairs Utility Installations Trade Fixtures and Alterations (a) Section 8.1(a) is amended in its entirety to read as follows: Subject to the provisions of Sections 8.2, 10, and 15, Tenant shall, at Tenant's sole cost and expense and at all times, keep the Building Complex and every part thereof in good order, condition and repair (whether or not the need for such repairs occurs as a result of Tenant's use, any prior use, the elements or the age of such portion of the Building Complex), including, without limiting the generality of the foregoing, plumbing, electrical lighting facilities, boilers, fired or unfired pressure vessels, fire hose connections, fixtures, interior walls, exterior walls, roof, ceilings, floors, windows, doors, plate glass, and skylights, parking areas and lighting, driveways, sidewalks, landscaping, irrigation systems, and subject to Section 8.1(b) below, heating, air conditioning and ventilating systems, but excluding any items which are the responsibility of Landlord pursuant to Section 8.2 below. Tenant, in keeping the Building Complex in good order, condition and repair, shall exercise and perform good maintenance practices, including, without limitation, providing janitorial services to the Building Complex substantially equivalent to those attached hereto as Exhibit I and, snow, ice and trash removal service. Tenant's obligations shall include restorations, replacements or renewals when necessary to keep the Building Complex and all improvements thereon or a part thereof in good order, condition and state of repair. (b) Section 8.1(b) is amended in its entirety to read as follows: Tenant shall procure and pay the cost of a contract for maintenance of the heating, air conditioning and ventilating systems for the Building Complex with a reputable contractor licensed in the State of Colorado and reasonably satisfactory to Landlord. (c) Section 8.1(c) is amended to replace, in both places where it is used, the word "Premises" with the words "Building Complex" and to add the words "including, without limitation, the Premises," before the words "after twenty". (d) Section 8.2 is amended in its entirety to read as follows:

  • Building Use Agency facilities may be used for Union activities according to current building use policies, so long as the facility is available and proper scheduling has been arranged.

  • Building With respect to each parcel of Real Estate, all of the buildings, structures and improvements now or hereafter located thereon. Business Day. Any day on which banking institutions located in the same city and State as the Agent’s Head Office are located are open for the transaction of banking business and, in the case of LIBOR Rate Loans, which also is a LIBOR Business Day.

  • Utility Installations Trade Fixtures Alterations 8.3.1 The term “Utility Installations” refers to all floor and window coverings, air and/or vacuum lines, power panels, electrical distribution, security and fire protection systems, communication cabling, lighting fixtures, HVAC equipment, plumbing, and fencing in or on the Premises. The term “Trade Fixtures” shall mean Lessee’s machinery and equipment that can be removed without doing material damage to the Premises. The term “Alterations” shall mean any modification of the improvements, other than Utility Installations or Trade Fixtures, whether by addition or deletion. “Lessee Owned Alterations and/or Utility Installations” are defined as Alterations and/or Utility Installations made by Lessee that are not yet owned by Lessor pursuant to Section 8.4.1.

  • Capital Improvements From and after Final Completion, Tenant shall not replace or materially alter the Project, or any part thereof (except as provided to the contrary with respect to Fixtures in Article 13), or make any addition thereto, whether voluntarily or in connection with repairs required by this Lease (collectively, “Capital Improvements”), unless Tenant shall comply with the following requirements and, if applicable, with the additional requirements set forth in Section 11.10: (a) No Capital Improvements shall be undertaken, as applicable, until Tenant shall have procured from all Governmental Authorities and paid for all permits, consents, certificates and approvals for the proposed Capital Improvements which are required to be obtained prior to the commencement of the proposed Capital Improvements (collectively, “Improvement Approvals”). The FCRHA shall not unreasonably refuse to join or otherwise unreasonably refuse to cooperate in the application for any such Improvement Approvals, provided such application is made without cost, expense or liability (contingent or otherwise) to the FCRHA. True copies of all such Improvement Approvals shall be delivered by Tenant to the FCRHA prior to commencement of the proposed Capital Improvements. (b) The Premises after completion of such Capital Improvements, shall have a value at least equal to the value of the Premises immediately before construction of such Capital Improvements. In addition, the Project shall at all times remain in substantial conformity with the original Plans and Specifications therefor (except to the extent specifically consented to by the FCRHA, in its sole but reasonable discretion). (c) All Capital Improvements shall be made with reasonable diligence and continuity (subject to Unavoidable Delays) and in a good and workmanlike manner and in compliance with (i) all Improvement Approvals, (ii) if required pursuant to Section 11.10(a) or (b), in substantial accordance with the plans and specifications for such Capital Improvements as approved by the FCRHA, and (iii) all Applicable Laws. (d) No construction of any Capital Improvement shall be commenced until Tenant shall have delivered to the FCRHA certificates of insurance and copies of the declaration page(s) for the insurance required by Exhibit D. Such insurance policies shall comply with the terms of Section 7.02 above.

  • LEASE ALTERATIONS The Owner hereby gives power to the Agent to initiate, sign, renew, modify, or cancel rental agreements and leases for the Property, or any part thereof and collect and give receipts for rents, other fees, charges, and security deposits.

  • Landlord Approval (Check one)

  • Undue Burden and Fundamental Alteration For any technology-related requirement in this Agreement for which the Recipient asserts an undue burden or fundamental alteration defense, such assertion may only be made by the Superintendent or by an individual designated by the Superintendent and who has budgetary authority after considering all resources available for use in the funding and operation of the service, program, or activity, and must be accompanied by a written statement of the reasons for reaching that conclusion, including the cost of meeting the requirement and the available funding and other resources. The written statement will be certified by the determining official. If such a determination is made, the certifying official will describe in the written statement how it will provide equally effective alternate access, i.e., other action that would not result in such an alteration or such burdens but would nevertheless ensure that, to the maximum extent possible, individuals with disabilities receive the same benefits or services provided by the Recipient as their nondisabled peers.

  • Fixtures and Alterations After taking occupancy of the Designated Space, AGENCY shall not, without the COUNTY’S prior written consent, attach any fixtures in or to the Designated Space or change, alter, or make additions to the Designated Space, nor attach or affix any article hereto, nor permit any annoying sound device, overload any floor, or deface the Designated Space. Such prior written consent shall not be unreasonably withheld. Where the COUNTY has approved AGENCY’S modifications to the Designated Space, the AGENCY shall only be required to remove its modifications and restore the Designated Space to its original condition upon the AGENCY’S vacating of the Designated Space should the COUNTY’S approval make such restoration a requirement of its approval. If, however, AGENCY elects to remove its modifications upon vacating the Designated Space, then AGENCY, at its expense, shall restore the Designated Space to its original condition, ordinary wear and tear excepted.

  • Building Codes The following Building Codes, in the latest editions approved by the Georgia Department of Community Affairs, shall be used. (See O.C.G.A. §8-2-20.) The Design Professional will designate any additional codes or special modifications in the Supplementary General Conditions.
