Lost, Stolen or Damaged Equipment. 14.1 If the Equipment:
(a) has broken down; or
(b) become unsafe to use as a result of Your negligence; or
(c) is lost, stolen, or damaged beyond fair wear and tear, between the time that it was delivered or taken by you and the time at which it is returned to Us, You will be liable for:
(d) any costs incurred by Us to recover and repair or replace the Equipment; and
(e) the hire charges for that portion of the Hire Period during which the Equipment is being recovered and repaired or replaced.
14.2 Provided that You pay the costs and charges described in clause 14.1, We will return the Equipment to You once it has been repaired or replaced, and You will continue to pay the hire charges for the remainder of the Hire Period.
Lost, Stolen or Damaged Equipment. 14.1 You are responsible for ensuring the safe return of all equipment.
14.2 You will cover the cost of any repairs or cleaning required for returned equipment.
14.3 If equipment is lost, stolen, or damaged beyond repair, you must compensate us for the replacement cost, as well as any associated financial losses.
Lost, Stolen or Damaged Equipment. 14If any part of the equipment is lost, stolen or damaged beyond economic repair (except where it was caused by our breach or negligence), you must promptly tell us and pay us the present value of the equipment. If this occurs before the expiry of the applicable repayment term, early termination charges may apply.
Lost, Stolen or Damaged Equipment. 18.1. In the event that the Equipment is lost, stolen or damaged beyond fair wear and tear during the Hire Period, or has broken down or become unsafe to use as a result of your negligence, you will be liable for:
18.1.1. the Rent for that portion of the Hire Period during which the Equipment is being recovered and repaired or replaced; and
18.1.2. any costs incurred by Bear Rentals to recover and repair or replace the Equipment.
18.2. You will be fully responsible to Bear Rentals for the cost of all repairs and/or replacement to Equipment for any loss, theft or damage to Equipment that occurs during the Hire Period.
18.3. If you fail to carry out any of your obligations under this Hire Contract, Bear Rentals shall be authorised to undertake the same and charge the costs and expenses of that to you.
Lost, Stolen or Damaged Equipment. 8.1 If any Equipment is lost, stolen or damaged beyond economic repair you must immediately notify us in writing and at your cost replace that Equipment with equipment of like nature approved by us. Title in respect of such replacement equipment will vest in us from the date on which it is delivered to you and this Agreement will continue with respect to that equipment as if it was the original Equipment. You agree and undertake to accept delivery of such replacement equipment on our behalf with the intention that we will become owner of such equipment. You agree to enter into an amended Rental Schedule recording the replacement equipment.
8.2 Provided you have complied with your obligations under clause 8.1 we will pay to or credit you with the amount of any insurance proceeds which we may receive under clause 7.
Lost, Stolen or Damaged Equipment. 8.1 If the Equipment is lost or stolen or not returned to the Owner for any other reason, the Hirer will be liable for the full new replacement cost of the Equipment, unless expressly agreed otherwise in the Hire Agreement.
8.2 If the Equipment is damaged, the Hirer will be liable for the cost of repairing any damage to the Equipment, unless expressly agreed otherwise in the Hire Agreement. The Hirer must provide full details of any accident or damage to the Equipment to the Owner within 2 business days of the accident or damage occurring.
Lost, Stolen or Damaged Equipment. 8.1 The Customer is responsible for the Equipment and any accessory and tools during the Hire Period. If the Equipment is lost, stolen, destroyed or damaged during the Hire Period beyond Fair Wear and Tear, or becomes unsafe to use due to any act or omission of the Customer, the Customer must immediately notify ASAH in writing within 24 hours and the Customer is liable to ASAH for and must indemnify ASAH for:
(a) the full cost of either:
(i) repairing the Equipment; or
(ii) replacing the Equipment with new equipment, as determined by ASAH in its sole and absolute discretion; and
(b) any other costs whatsoever arising from or in connection with the loss, theft or damage to the Equipment including but not limited to Hire Charges, Claim, Damage and/or Loss until the replacement value is paid to ASAH; and
(c) any lost revenue, including Loss of Use, arising from or in connection with the loss, theft or damage to the Equipment until the replacement value is paid to ASAH.
8.2 If, the Customer has paid the LTD Fee, the Customer's liability is limited as provided in clause 9 below.
Lost, Stolen or Damaged Equipment. A cable television company shall provide notice to subscribers of any charges for lost, stolen or damaged equipment in accordance with section 890.64(f) of this Part.
Lost, Stolen or Damaged Equipment. A) Lessee will at Lessee's sole expense keep and maintain the Equipment in good working order during the Lease Term. In the event the Equipment is lost or damaged beyond repair, Lessee shall pay to Lessor the replacement cost of the Equipment; in addition, the obligations of this Agreement shall continue in full force and effect through the Lease Term.
B) Equipment will be deemed to be "lost" when Lessee has failed to return the Equipment to Lessor within seven (7) calendar days of expiration of Term. After seven (7) days, if the Equipment has not been returned in good order, Lessee will pay to the Lessor the replacement cost of the Equipment, above and beyond any assessed rental fees. If, after thirty (30) days, the Equipment has not been returned and the Lessor has been unable to recover replacement cost, the equipment shall be considered “stolen”.
C) In the event of damage of any kind whatsoever to the Equipment, Lessee agrees to immediately contact the Lessor with an accurate description of the damage and the circumstances of its occurrence. Lessor expressly reserves the right to choose the repair method and venue, within reasonable market value terms. Lessee agrees to be bound, legally and otherwise, by the report of Lessor's chosen repair venue as to the cause of the damage to the Equipment.
D) In the event of loss or damage of any kind whatsoever to the Equipment, Lessee shall, at Lessor's option:
(i) Pay to Lessor to place the same in good repair, condition and working order; or
(ii) Pay to Lessor the replacement cost of the Equipment.
Lost, Stolen or Damaged Equipment. If at any time during the Hire Period, the Equipment (or part of it) is lost or stolen, or damaged to the point of no longer being usable for Commuting, you will still be responsible for making any remaining payments due under this agreement, but the tax exemptions referred to in section 2 (Eligibility for Tax Benefits) above may cease to apply. Where this happens, you will effectively be required to make the remaining payments out of your net salary. You are strongly advised to obtain specific insurance for the Equipment, or otherwise ensure it is covered by your home contents insurance policy. You must inform your insurer that the Employer has an interest in the Equipment. Please note that if you purchase any replacement equipment following the theft or loss of the Equipment you originally obtained under this agreement, that replacement equipment will not be covered by the terms of this agreement and the tax exemptions referred to in section 2 (Eligibility for Tax Benefits) above will not apply.
