Lost-Time Claims Clause Samples

The Lost-Time Claims clause defines how claims related to work stoppages or delays due to lost time are handled under the contract. It typically outlines the procedures for notifying the other party of a lost-time event, the documentation required to substantiate the claim, and the process for assessing any resulting adjustments to the project schedule or compensation. This clause ensures that both parties have a clear mechanism for addressing and resolving delays caused by unforeseen events, thereby minimizing disputes and maintaining project timelines.
Lost-Time Claims. Class Members can submit a Claim Form for reimbursement for time spent remedying issues related to the Data Breach for up to four (4) total hours at a rate of $25 per hour capped at $100 (“Lost- Time Claims”). Class Members do not need to submit any documentation in connection with Lost-Time Claims, but Class Members must attest that the time claimed was actually spent as a result of the Data Breach.
Lost-Time Claims. You may submit a claim for reimbursement for time spent resolving issues attributable to the Data Security Incident. You will be reimbursed at $25/hour for up to 5 hours of time spent, up to $125 total. By filling out this claim form, you must attest to the amount of time you spent attempting to mitigate the effects of the Data Security Incident on your life. This can include, for example, time spent on the phone with banks, time spent dealing with replacement card issues or reversing fraudulent charges, time spent monitoring accounts, or time spent freezing your credit. You do not have to include documentation of your lost time. Instead, you can swear, under penalty of perjury, to the amount of time you spent.
Lost-Time Claims. Claims-Made Settlement Class Members may submit a Claim for up to two (2) hours of time spent related to the Data Incident at $25 per hour if the Settlement Class Member (1) attests that any claimed lost time was spent related to and arising out of the Data Incident, and (2) provides a brief general description of how the claimed lost time was spent. No documentation need be submitted in connection with Lost-Time Claims.
Lost-Time Claims. Non-SSN Settlement Class Members may submit a Claim for up to two (2) hours of time spent related to the Data Security Incident at $25 per hour if the Settlement Class member (i) attests that any claimed lost time was spent related to and arising out of the Data Security Incident and (ii) provides a brief general description of how the claimed lost time was spent. No documentation need be submitted to be eligible to receive the benefit of Lost-Time Claims.
Lost-Time Claims. With respect to Lost-Time Claims, Professional will provide whatever services may reasonably be required to make a determination regarding compensability, pay the appropriate level of indemnity benefits, and attempt to achieve a return to full active duty.

Settlement Class members must: (1) attest that any claimed lost time was spent related to and arising out of the Data Incident, and (2) select the applicable activity the time was spent on or provide a brief general description of how the claimed lost time was spent. No documentation need be submitted in connection with Lost-Time Claims. The Settlement Administrator will make lost-time payments to claimants who are eligible for Category One from the Common Fund, and the Settlement Administrator will make lost-time payments to claimants who are eligible for Category Two outside of the Common Fund but subject to a $300.00 total per Class Member Claims-Made cap.
