Machinery & Equipment. The Authority shall upon receiving a request from the Contractor, provide the machinery & equipment specified in Schedule-P on payment of hire charges at the monthly rates specified therein. The Parties agree that the monthly rate for each machine or equipment shall be inclusive of fuel and all other operating charges, which shall be converted into daily rates taking a month comprising 25 (twenty five) working days. The Parties further agree that for each machinery or equipment:
(a) the charges shall be payable for a day even if a machine or equipment is used for less than 8 (eight) hours, so long as it has been placed at the disposal of the Contractor and has not been withdrawn;
(b) the daily rates shall be computed for a shift of 8 (eight) hours taken as one day. By way of illustration, if the machinery or equipment is used for 16 (sixteen) hours on any day, the charges payable shall be equal to twice the daily rate; and
(c) [for any machinery or equipment which can be used only during the period of a Power Block or Traffic Block, no payment shall be due or payable for the day on which such block is not provided to the Contractor.] The Contractor shall by notice of at least three weeks convey to the Authority the particulars of the machinery & equipment required for each day of the following one month.
Machinery & Equipment. The machinery equipment located, as of the Closing Date, at the Leased Premises, as described in Exhibit C hereto (hereinafter the "Machinery Equipment");
Machinery & Equipment. All of the machinery, equipment, office and computer equipment, furniture, furnishings, fixtures, jigs, dies, tooling, patterns, tooling fixtures, trucks, motor vehicles and all other fixed tangible assets owned by Seller and used by Seller in the Embassy Business, including those identified in Schedule 1.1.1 attached hereto (the “Machinery & Equipment”), together with any rights of Seller to all warranties, and guaranties by, and rights, choses in action, and claims, known or unknown, matured or unmatured, accrued or contingent against third parties relating to any other Assets, including rights in and to insurance and indemnity claims of the Seller relating to any such other Assets, if any, and to the extent assignable, received from the manufacturers and sellers of such items;

Machinery & Equipment. The machinery equipment located, as of the Closing Date, at the Real Property and those located in Sovico, as described in Exhibit C hereto (hereinafter the "Machinery Equipment");
Machinery & Equipment. AKTA automatic chromatographic systems, XS2 automatic pharmaceutical container inspection machines, vacuum refrigerating dryers and other machinery equipment, with [1,468] units in total;
Machinery & Equipment. All the machinery, equipment, trailers, office equipment, furniture, furnishings, trade fixtures, computer hardware, phone and fax numbers, and vehicles located at Seller's principal business, including all tangible personal property utilized in the manufacture of the diaper product line (including Diaper Machine No. 1, Diaper Machine No. 2, forklift trucxx, Xxxxxx Xxxxxx, xxxxx xxchinery and equipment). The equipment shall be specifically identified and described on a schedule prepared and attached hereto prior to or coincident with Closing.
Machinery & Equipment. All of the machinery, equipment, office equipment, furniture, furnishings, fixtures, jigs, dies, tooling, patterns, tooling fixtures, trucks, motor vehicles and all other fixed tangible assets of Seller used in the Xxxxxxxxx Business identified in Schedule 1.1.1 attached hereto (the "Machinery & Equipment"), together with any rights of Seller to all warranties, if any, and to the extent assignable, received from the manufacturers and sellers of such items;
Machinery & Equipment i. All representations made by Borrower to LTS, and all documents and schedules given by Borrower to LTS, relating to the description, quantity, quality, condition and valuation of the Machinery & Equipment (“M&E”) are and shall be materially true and correct.
ii. Borrower has marked all M&E funded by LTS and/or has segregated it from all other M&E.
iii. All M&E is located only at the address or addresses of Borrower which have been disclosed to LTS in writing, and landlord, warehouse and mortgagee waivers, as applicable, for all such locations have been provided to LTS.
iv. No M&E will be moved from its current location without prior written notice to LTS.
v. All M&E will be properly maintained in accordance with manufacturers’ requirements.
vi. All M&E will be insured as required in the Credit Agreement or as otherwise required by LTS.
Machinery & Equipment. 5.1 The contractor shall provide all equipment, all fuel and maintain all equipment required for the completion of the project.
