Maintenance of Information and Records. Medical Group shall maintain all information and records reviewed or created in connection with performing the Delegated Activities in a form acceptable to PacifiCare, provide PacifiCare with access to such information and records, and permit PacifiCare to review and copy such information and records.

Provider agrees (a) to maintain Information and Records (as such terms are defined in Section 5.3.2) in a current, detailed, organized and comprehensive manner and in accordance with Government Sponsor directives, applicable Federal and state laws, and accreditation standards; (b) that all Member Confidential Information shall be treated as confidential and in accordance with applicable laws; (c) to maintain such Information and Records for the longer of six (6) years after the last date Provider Services were provided to Member, or the period required by applicable law or Government Sponsor directives; and (d) to maintain Information and Records in accordance with the requirements of Exhibit A. This Section 5.3.1 shall survive the termination of this Agreement, regardless of the cause of the termination.

Facility agrees: (a) to maintain Information and Records (as such terms are defined in Section 5.3.2) in a current, detailed, organized and comprehensive, accurate and timely manner and in accordance with customary medical practice, applicable Federal and state laws, and accreditation standards; (b) that all Member medical records and Confidential Information shall be treated as confidential and in accordance with applicable laws, including but not limited to, the requirements set forth in 42 C.F.R. §§ 422.136; and (c) to maintain such Information and Records for the longer of six (6) years after the last date Facility Services were provided to Member, or the period required by applicable law. This Section 5.3.1 shall survive the termination of this Agreement, regardless of the cause of the termination.

Group agrees to maintain Information and Records (as those terms are defined in the Access to Information and Records Section below) in a current, detailed, organized and comprehensive manner and in accordance with Mandates, and to maintain such Information and Records for the longer of: (i) a period of ten (10) years from the end of the final contract period of any government contract of Preferred Provider to offer an Preferred Provider Medicare PPO plan, (ii) the date the U.S. Department of Health and Human Services, the Comptroller General or their designees complete an audit, or (iii) the period required by Mandates. This Provision shall survive the termination of this Group Agreement, regardless of the cause of the termination.

Lifemark Texas shall maintain all records reviewed or created in connection with performing the Activities in a form acceptable to HMO, provide HMO with access to such information and records, and permit HMO to review and copy such information and records, in accordance with the requirements of State and federal law. Lifemark Texas shall create, keep and maintain records in accordance with TDHS Contract Section 3.5 and other requirements as specified by federal or State laws or regulations.
