MAINTENANCE OF THE APARTMENT/ PROJECT. The Developer shall be responsible to provide and maintain essential services in the Project till the taking over of the maintenance of the Project by the association of Allottees upon the issuance of the completion certificate or such other certificate by whatever name called issued by the competent authority of the Project. The cost of such maintenance from the date of the Allottees taking over physical possession and/or from the Possession Date, (as mentioned in 7.1 above) whichever is earlier, is payable by the Allottees for the Apartment proportionately as per the rates to be calculated on per square feet basis (of the carpet area of the Apartment) and/or in the manner as provided in this agreement and/or as may be so decided by the Developer and/or the association of Allottees, as the case may be.

10.2 The cost of such maintenance from the date of the Purchasers taking over physical possession and/or from the Possession Date, (as mentioned in the Said Agreement) whichever is earlier, is payable by the Purchasers for the Apartment proportionately as per the rates to be calculated on per square feet basis (of the carpet area of the Apartment) and/or in the manner as provided in this Conveyance and/or as may be so decided by the Developer and/or the association of all the flat owners, as the case may be.

12.1 INTERIM MAINTENANCE PERIOD During the interim maintenance period between obtaining of the completion certificate of Project and formation of the Association the Developer shall through itself or through a facility management company constitute a committee to run, operate, manage and maintain the Common Areas.
12.1.1. The Developer shall endeavour that the committee responsible for the maintenance and operation of the Common Areas will be required to provide manpower for maintaining the Common Areas, wherever required, and to collect maintenance charges and the user charges for the utilities being provided on “pay by use” basis, if any.
MAINTENANCE OF THE APARTMENT/ PROJECT. The Promoter shall be responsible to provide and maintain essential services in the Project till the taking over of the maintenance of the Project by the Association of Allottees upon the issuance of the completion certificate of the Project subject to the Alottees paying the (maintenence charges @ 7/- per sq ft per month of the super built up area of the Apartment as will be so notified by the Promoter or as actual whichever is lower) provided, however, that there will be no maintenance charges payable for eighteen months for the unsold inventory and/or unsold Apartments in the Project.
MAINTENANCE OF THE APARTMENT/ PROJECT. The Promoter shall be responsible to provide and maintain essential services of the Project till the taking over of the maintenance of the Project by the Association of the purchasers upon the issuance of the Completion Certificate or Partial Completion Certificate, as the case may be, of the Project. The cost of such maintenance which had been mentioned in the break- up of the Total Price of the Apartment in the Agreement For Sale or the provisional allotment letter, as the case may be, was based on the Consumer Price Index (CPI) published by Central Statics Office (CSO) (Ministries of Statics and Programme Implementation) as on January, 2016 assuming that the Association shall be formed and maintenance and management of the Common Areas & common facilities will be taken over by the purchasers within a period of 2 (two years) from the date of the Completion Certificate or Partial Completion Certificate, as the case may be of the Project. In case the formation of the Association is delayed beyond the two year period, the Promoter shall provide and maintain the essential services in the Project till the Association is formed and the Project is handed over to the Association and the purchasers shall pay to the Promoter the charges for such maintenance as fixed by the Promoter, on the basis of then prevailing CPI as mentioned above or may hand it over to the Competent Authority.
MAINTENANCE OF THE APARTMENT/ PROJECT a. The Promoter shall be, either by itself or through its nominated agent, responsible to provide and maintain the Project, including the Common Areas, till taking over of the maintenance of the Project by the association of purchasers subject to purchasers making payment of the maintenance charges agreed under these presents.
b. The terms, conditions, covenants, restrictions etc., pertaining to use and enjoyment of the Common Areas of the Project are contained in SIXTH SCHEDULE hereto and all the purchasers of the Apartment shall be bound and obliged to comply with the same.
c. The Allottee shall be liable to pay interest @2% (two present) per month on the due amounts and if such default shall continue for a period of 3 (three) months then in that event, the Allottee shall not be entitled to avail of any of the facilities, amenities and utilities provided in the Project and the Promoter/association of allottees as the case may be, shall be entitled to take the following measures and the Allottee hereby consents to the same:
(i) not to allow the usage of lifts, either by Xxxxxxxx, his family members, domestic help and visitors.
(ii) to discontinue the facility of DG Power back-up
(iii) to discontinue the usage of all amenities and facilities provided in the Project to the Allottee and his family members/guests.
(iv) the Promoter / association of allottees as the case may be shall be having lien on the Project for such unpaid amount of maintenance charges. The above said discontinuation of some services and facilities shall not be restored until such time the Allottee has made payment of all the dues together with interest accrued at the aforesaid rate, including all costs charges and expenses incurred till then by the Promoter/association of allottees to realize the due amount from the Allottee.
