MAINTENANCE RESPONSIBILITY AND INSPECTION RIGHTS. BMC shall conduct pre- and post-inspections of the TSP Vehicle, complete required reports, and promptly notify Ryder of any TSP Vehicle condition issues. Ryder will not be liable for any FMCSA violations or other citations. For TSP Vehicles operated in California, LP shall be responsible for the maintenance of the TSP Vehicle maintenance files and periodic vehicle inspections required by the Basic Inspection of Terminals (BIT) program. Instructions for pre- and post-trip inspections are provided in the TSP Platform and BMC shall comply with all such instructions. BMC agrees to be responsible and pay for all mechanical damage to the TSP Vehicle caused by: (i) BMC's breach of any provision of the TSP Documentation; (ii) BMC's failure to maintain adequate oil, fluids, coolants, and water levels in the engine; and/or (iii) BMCs neglect of any necessary servicing or maintenance of the TSP Vehicle during the rental period. BMC will not perform, and Ryder will not be responsible for, any service, repairs, or other maintenance to the TSP Vehicle during the rental period unless Ryder gives prior written authorization for such work. Ryder may inspect the TSP Vehicle at any time wherever it is located. In accordance with the owner's manual, the engine in the TSP Vehicle may require Diesel Exhaust Fluid or a similar additive (DEF). All charges for DEF are BMC's responsibility. Failure to maintain required tank levels or adding non DEF fluids to this tank may cause TSP Vehicle derate or system damage. Any failure to maintain required proper DEF fluid level is driver abuse and BMC is responsible for all mechanical damage resulting from such failure. Where applicable, instructions for DPF regeneration may be located on the backside of the driver’s side sun visor. It is BMC’s sole responsibility to properly and timely perform the regeneration. Any failure to perform DPF regeneration is driver abuse and BMC is responsible for all costs necessary to repair and tow the TSP Vehicle as well as any other mechanical damages resulting from such failure.

  • Maintenance Responsibilities 42. Agency shall, at its own expense, maintain operate, and provide power as needed upon Project completion at a minimum level that is consistent with normal depreciation and/or service demand and throughout the useful life of the Project. The useful life of the Project is defined in the Special Provisions. State may conduct periodic inspections during the life of the Project to verify that the Project is properly maintained and continues to serve the purpose for which federal funds were provided. Maintenance and power responsibilities shall survive any termination of the Project Agreement. In the event the Project will include or affect a state highway, this provision does not address maintenance of that state highway.

  • Maintenance and Inspection Consultant shall maintain complete and accurate records with respect to all costs and expenses incurred under this Agreement. All such records shall be clearly identifiable. Consultant shall allow a representative of City during normal business hours to examine, audit, and make transcripts or copies of such records and any other documents created pursuant to this Agreement. Consultant shall allow inspection of all work, data, documents, proceedings, and activities related to the Agreement for a period of three (3) years from the date of final payment under this Agreement.

  • Maintenance and Inspection of Records The City, or its authorized auditors or representatives, shall have access to and the right to audit and reproduce any of the Contractor's records to the extent the City deems necessary to insure it is receiving all money to which it is entitled under the Contract and/or is paying only the amounts to which Contractor is properly entitled under the Contract or for other purposes relating to the Contract. The Contractor shall maintain and preserve all such records for a period of at least three (3) years after termination of the Contract. The Contractor shall maintain all such records in the City of Xxxxxx. If not, the Contractor shall, upon request, promptly deliver the records to the City of Xxxxxx or reimburse the City for all reasonable and extra costs incurred in conducting the audit at a location other than the City of Xxxxxx, including, but not limited to, such additional (out of the City) expenses for personnel, salaries, private auditors, travel, lodging, meals, and overhead.

  • Responsibility for Quality of Materials and Installation Contractor acknowledges that he has full, total, and complete responsibility for providing materials, labor, and all other items necessary for providing the level of quality specified in the Contract Documents. He agrees that this responsibility is indivisible, non-delegable, non- transferable, and not diminished by any inspections provided by the Design Professional or his consulting engineers, nor by any inspections provided by the Owner. In recognition of this, Contractor will prepare for submission and review by the Design Professional, a written program describing the efforts that will be taken to insure the proper quality level is achieved. The program shall be submitted prior to the issuance of a Proceed Order.

  • Tests and Inspections 5.2.1 Tests and Inspections shall comply with title 24, part 1, California Code of Regulations, group 1, article 5, section 4-335, and with the provisions of the Specifications.
