Other Maintenance. The Contractor shall routinely inspect all plants and lawn for proper watering. If a problem is detected with the irrigation system, the Contractor shall contact the City. Contractor is not responsible for death of plants due to malfunction of irrigation system. The following Ground Maintenance program will be performed once a week and as needed throughout the Fall seasons: A. Perennial flowers and grasses: Plants will be trimmed back to the ground at the end of the growing season. Flower beds shall be kept free of all trash and debris. In addition, occasional plant loss is common in our climate, and Contractor shall report any concerns about such loss to the City. Contractor shall fulfill any other duties necessary to keep the grounds of the facility in a neat and orderly state. Other Maintenance. 12.1 The Operator may from time to time undertake minor wear and tear repairs in the Villa at its own cost, at its own discretion. 12.2 Repairs, maintenance and replacement of common property (including the external villas) is the responsibility of all owners at the Resort to which the Owner will contribute by way of Resort Rules levies and will not be at the expense of the Operator. 12.3 All other repair, maintenance and replacement to maintain the standard of the Villa and its FF&E as required by clause 4.1.6 is to be undertaken at the cost of the Owner in accordance with the terms of this Agreement. To clarify: 12.3.1 The cost of any repair, replacement or maintenance of the FF&E will be dealt with in accordance with clauses 11.2 to 11.5. 12.3.2 General maintenance and repairs of the Villas’ interiors (non-FF&E) will be undertaken under the supervision of the Operator and the costs of these works will be deducted from the Pooled Owner Retention. General repairs and maintenance include day to day repairs on a like for like basis for the continuation, protection, repair and upkeep of the Villas. This includes items which are considered, at the Operator's discretion, too minor in dollar terms to form part of the FF&E and includes such things as crockery, cutlery, glassware, pillows, light bulbs and batteries. See Schedule 1 Part B(1). 12.3.3 The Operator will notify the Owner of any additional works that are required to be undertaken at the Owner's expense in order to maintain the standard of the Villa and seek the Owner's consent to such works (not to be unreasonably withheld), the cost of which may be paid directly by the Owner to the Operator or deducted from the Owner's share of Net Rental Income. Other Maintenance. Other Maintenance expense includes the cost of repairing rotable (reusable) parts for the aircraft, the cost of purchasing expendable (single use only) parts, and the cost of leasing parts. Budgeted Other Maintenance expense for the year ending June 30th, 2012 is $2,041K. This cost is budgeted to decrease slightly as many of the expenses in the 2012 year will be able to be capitalized with the engine overhauls and aircraft heavy checks.

Other Maintenance. (1) The Lessee at its own expense shall keep the sidewalks, parking areas, driveways and walkways forming part of the demised premises and the sidewalks and walkways immediately adjacent to the demised premises at all times clear of ice and snow, dirt and other debris and at its own expense shall properly maintain the landscaping of the lands forming part of the demised premises and shall cut the grass and keep down and control noxious weeds which may grow on the lands forming part of the demised premises and shall keep the yard clean and tidy and shall deposit all refuse in suitable containers and dispose of the refuse as necessary, all at its own expense. (2) The Lessee will at the Lessee's expense, repair or replace any damaged or broken plate and other glass in the demised premises irrespective of the cause of such damage or breakage except damage or breakage caused by the wilful misconduct or negligence of the Lessor or the Lessor's agents. (3) The Lessee will protect the floors of the building forming part of the demised premises from damage by chemicals and other materials and substances used by the Lessee in the conduct of its business. (4) The Lessee will at its own expense be responsible for ongoing maintenance of the roof to a maximum of one thousand five hundred dollars ($1,500.00) per lease year. (5) The Lessee will pay the cost of all electric light bulbs, fluorescent tubes and ballasts used in or on the demised premises, including the cost of installation and replacement of them.
