Common use of MANAGEMENT FUNCTION Clause in Contracts

MANAGEMENT FUNCTION. 2.01 The Union recognizes that the management of the plant and direction of the working forces are fixed exclusively in the Company, and without restricting the generality of the foregoing, the Union acknowledges that it is the exclusive function of the Company to: a) Maintain order and efficiency; b) Hire, discharge, direct, classify, transfer, lay-off, recall and suspend or otherwise discipline employees, provided that if an employee has been discharged or disciplined without just cause, a grievance may be filed and dealt with in accordance with the Grievance Procedure. c) Determine the nature and kind of business conducted by the Company, the kinds and locations of equipment and materials to be used, the control of materials to be used, the control of materials and parts, the methods and techniques of work, the schedules of work, number of personnel to be employed, the extension, limitation, curtailment or cessation of operations, and to determine all other functions and prerogatives herebefore vested in and exercised by the Company which shall remain solely with the Company, except as specifically limited by the express provisions of this Agreement. 2.02 The Company agrees that these functions will be exercised in a manner not inconsistent with the provisions of this Agreement.
