Master Declaration. “Master Declaration” shall mean that certain Declaration of Covenants, Conditions, Restrictions and Easements for Sian Ocean Residences & Resort Master Association, as recorded on February 27, 2006 in the Official Records Book 41532 at Page 1989 of the Public Records of Broward County, Florida, as same may be amended.
Master Declaration. The Planned Community, including the Property, is subject to that certain Master Declaration of Covenants, Conditions and Restrictions for The Villages at Tule Springs and recorded on May 1, 2017 as Document No. 20170501-0003-18 in the Official Records, as further amended by that certain First Amendment to Master Declaration dated as of August 9, 2018 and recorded on September 19, 2018 as Instrument No. 20190919-0002159 (as amended, the “Master Declaration”). A copy of the Master Declaration has been provided to Buyer as part of the Property Materials. The Master Declaration is a Permitted Exception with respect to each Owner’s Title Policy. An affiliate of Seller is the declarant under the Master Declaration (the “Declarant”). 4.6.2
Master Declaration. The Master Declaration imposes upon the City Springs Project certain covenants, conditions, restrictions, reservations and easements for the purpose of insuring the proper use and appropriate development, administration, maintenance and improvement of the City Springs Project and to assist in implementing the Master Plan. The Master Declaration will be recorded in the real estate records of the Clerk of Superior Court of Xxxxxx County, Georgia, prior to Closing and will govern, among other things, the development, construction, maintenance, use and operation of City Springs, and will specifically incorporate the following restrictions and easements for the benefit of all owners within City Springs:
Master Declaration. Borrower shall not record the Master Declaration or any of the Master Association documents until the same have been approved by Lender, and once approved by Lender, Borrower shall not amend or modify the same without Lender's prior written consent, which shall not be unreasonably withheld or delayed.
Master Declaration. Costs incurred by the Board of Managers under the Master Declaration shall be allocated and billed by the Board of Managers to the Unit Owners in accordance with the Allocation Schedule.
Master Declaration. Except as Declarant may otherwise direct in writing, Purchaser covenants and agrees to and with Declarant that the Property and the interest of Purchaser therein, is bound by and subject to the Master Declaration as heretofore or hereafter amended. In the event that the terms and provisions of the Master Declaration conflict with the terms and provisions of the Purchaser Covenants, the terms and provisions contained in the Purchaser Covenants shall control. 2.5
Master Declaration. The following new Section 6.3(c) is added to the Existing Lease Agreement: The terms of the Original Lease Agreement shall be subject in all respects to, and the Tenant shall comply with, the provisions of that certain Master Declaration of Protective Covenants and Restrictions for Riverwoods Research and Business Park recorded October 24, 1991, as Entry No. 42273, in Book 2847, at Page 618 of the official records of Utah County (the "Master Declaration") any applicable Supplementary Declaration, the Articles, the Bylaws and the Association Rules (as all of those terms are defined in the Master Declaration). Any failure of Tenant to so comply shall constitute a default hereunder.
Master Declaration. Seller has delivered to Purchaser a complete and accurate copy of the Master Declaration. To Seller’s knowledge, there are no existing or uncured defaults by Seller or by Declarant under the Master Declaration.
Master Declaration. Landlord hereby represents and warrants to Tenant the following: (a) Tenant’s intended use of the Premises, as indicated in Article 5 of this Lease, is permitted under the Master Declaration; (b) notwithstanding anything to the contrary contained in the Declaration, Tenant may install on Parcel One an emergency generator power source which will store more than 1,000 gallons of fuel; and (c) to Landlord’s knowledge, Landlord is currently complying with the terms and conditions of the Master Declaration and Landlord shall use commercially reasonable efforts to comply with the terms of the Master Declaration throughout the Term.
Master Declaration. On or before the Closing Date, Seller shall execute and record in the land records of Arlington a Declaration of Covenants, Conditions and Restrictions (the "Master Declaration") in substantially the form attached as Exhibit E, which will benefit and burden all of the land known as the Arlington "South Tract" which includes the Land. The Master Declaration shall be an additional Permitted Exception.
