Measures to Monitor, Minimize, and Mitigate Negative Impacts. Management actions such as major earthwork, removal of nonnative aquatic species, pesticide application, and other management activities expected to result in take, will be scheduled in advance, and notification, at least 30 days before the activities, will be provided to the Department. This will allow the Department the opportunity to relocate fish temporarily if deemed necessary by the Department in consultation with the Service. If activities require long-term removal of fish, arrangements can be made to house them at alternative locations. If mosquitofish occur in any habitat covered under this Agreement, removal efforts must be attempted before topminnow and/or pupfish are released. If other nonnative aquatic species occur at potential sites, utilization of those habitats will be decided on a site- specific basis. Any loss of the populations due to such disturbances may require supplemental stockings of topminnow and/or pupfish. The Department will consult with the Service and criteria in the species’ recovery plans to determine the appropriate source population for initial and supplemental stockings.

Measures to Monitor, Minimize, and Mitigate Negative Impacts. Management actions such as major earthwork, removal of non-native vegetation, pesticide application, and other management activities, will be scheduled in advance, and notification at least 14 days before the activities will be provided to the Natural Resources Section of ADOT. Activities which are expected to result in major siltation or contamination of the channel will be delayed until the fish can be safely removed from the channel and temporarily housed in aquaria, fish farms (i.e., circular holding tanks) (Xxxxxxxxx et al. 1993), or small wading pools (Minckley, personal communication). If activities are going to require long-term removal of fish, arrangements can be made to house them at alternative locations or release them elsewhere. If mosquitofish occur in any water, they must be removed before Gila topminnow or desert pupfish are released. The mosquitofish in the Kyrene basin will be removed before reintroduction of pupfish and topminnow. If other non-native aquatic species occur at other potential reintroduction sites, the use of that basin must be decided on a site-specific basis. Actions such as annual trash clean-ups, research, and planting of native vegetation aren’t expected to result in significant take and can be minimized and mitigated by taking extreme care while performing these activities. Students, volunteers, and staff working in or around the channel will be supervised at all times by an ADOT employee, and instruction on proper safeguards will be provided to all personnel prior to initiating work in or around the channel.

  • Aggravating and Mitigating Factors The penalties in this matter were determined in consideration of all relevant circumstances, including statutory factors as described in CARB’s Enforcement Policy. CARB considered whether the violator came into compliance quickly and cooperated with the investigation; the extent of harm to public health, safety and welfare; nature and persistence of the violation, including the magnitude of the excess emissions; compliance history; preventative efforts taken; innovative nature and the magnitude of the effort required to comply, and the accuracy, reproducibility, and repeatability of the available test methods; efforts to attain, or provide for, compliance prior to violation; action taken to mitigate the violation; financial burden to the violator; and voluntary disclosure. The penalties are set at levels sufficient to deter violations, to remove any economic benefit or unfair advantage from noncompliance, to obtain swift compliance, and the potential costs, risks, and uncertainty associated with litigation. Penalties in future cases might be smaller or larger depending on the unique circumstances of the case.

  • Corrective Measures If the Participating Generator fails to meet or maintain the requirements set forth in this Agreement and/or the CAISO Tariff, the CAISO shall be permitted to take any of the measures, contained or referenced in the CAISO Tariff, which the CAISO deems to be necessary to correct the situation.

  • Uncontrollable Forces Tariff Provisions Section 14.1 of the CAISO Tariff shall be incorporated by reference into this Agreement except that all references in Section 14.1 of the CAISO Tariff to Market Participants shall be read as a reference to the Participating Generator and references to the CAISO Tariff shall be read as references to this Agreement.

  • Mitigation Measures Company shall take commercially reasonable measures (except measures causing it to incur out-of-pocket expenses which BNYM does not agree in advance to reimburse) to mitigate losses or potential losses to BNYM, including taking verification, validation and reconciliation measures that are commercially reasonable or standard practice in the Company’s business.

  • CORRECTIVE MEASURE The contractor shall repair any deficiencies in excess of the performance guideline.

  • Regulatory Event New Taxes If, after the Effective Date, a Regulatory Event occurs or New Taxes are imposed, and such event or taxes have a direct, material and adverse effect on the economic benefits to a Party of this ESA, the affected Party shall send written notice to the other Party, setting forth the Regulatory Event or New Taxes and reasonably demonstrating the effect of the same on the affected Party. Upon delivery of such notice, the Parties shall use reasonable efforts to negotiate an amendment to this ESA to mitigate such effect. Alternatively, if as a direct result of such a Regulatory Event or New Taxes, the Competitive Supplier incurs additional, material costs, the Competitive Supplier shall provide a written notice to the Town that documents: a) the effective date of the Regulatory Event or New Taxes; b) a detailed explanation and reasonable demonstration of the material costs incurred as a result of the Regulatory Event or New Taxes; c) the timing of the cost impact to be incurred by the Competitive Supplier; d) the proposed price increase per kWh to be passed on to Participating Consumers; and e) a proposed plan for coordinating with the Local Distributor for an increase in the price per kWh that is billed by the Local Distributor, designed to reimburse the Competitive Supplier for such cost impact. If the Town and the Competitive supplier cannot agree on the amendment to this ESA or reimbursement contemplated by this section, the matter may be subject to dispute resolution in accordance with section 12.2. In no event shall a price change become effective without providing Participating Consumers with a 30-day advance notice of the price change.

  • Mitigating Factors The Contractor had a Trafficking in Persons compliance plan or an awareness program at the time of the violation, was in compliance with the plan, and has taken appropriate remedial actions for the violation, that may include reparation to victims for such violations.

  • Human and Financial Resources to Implement Safeguards Requirements 6. The Borrower shall make available necessary budgetary and human resources to fully implement the EMP and the RP.

  • COOPERATION IN IMPLEMENTATION On demand of the other Spouse and without undue delay or expense, each Spouse shall execute, acknowledge, or deliver any instrument, furnish any information, or perform any other acts reasonably necessary to carry out the provisions of this Agreement. If a Spouse fails to execute any document as required by this provision, the court may appoint the court clerk or his or her authorized designee to execute the document on that Xxxxxx’s behalf.

  • Performance Measures and Metrics This section outlines the performance measures and metrics upon which service under this SLA will be assessed.
