Meter Inaccuracies and Retroactive Adjustments. (a) If any inspections or tests of the Metering Facilities disclose an error exceeding 0.5 percent, either fast or slow, proper correction, based upon the inaccuracy found, shall be made of previous readings for the actual period during which the Metering Facilities rendered inaccurate measurements if that period can be ascertained. If the actual period cannot be ascertained, the proper correction shall be made to the measurements taken during the time the Metering Facilities were in service since last tested, but not exceeding six (6) months, in the amount the Metering Facilities shall have been shown to be in error by such test. Any correction in xxxxxxxx or payments resulting from a correction in the meter records shall be made in the next monthly billing or payment rendered.

(a) If any inspections or tests of the Storage Facility Metering Facilities or Back-up Metering disclose an error exceeding one-half percent (0.5%), either fast or slow, proper correction, based upon the inaccuracy found, shall be made of previous readings for the actual period during which the Storage Facility Metering Facilities rendered inaccurate measurements if that period can be ascertained. If the actual period cannot be ascertained, the proper correction shall be made to the measurements taken during the time the Storage Facility Metering Facilities or Back-up Metering were in service since last tested, but not exceeding six (6) months, in the amount the Storage Facility Metering Facilities shall have been shown to be in error by such test. Any correction in xxxxxxxx or payments resulting from a correction in the meter records shall be made in the next monthly billing or payment rendered.
Meter Inaccuracies and Retroactive Adjustments. If, as determined under the ISO Tariff, including the ISO Business Practice Manual for Metering, the Meter fails to register, the measurement made by the Meter is found upon testing to be inaccurate by an amount exceeding the standard set forth in the ISO Tariff, or the Meter otherwise fails to comply with a standard set forth in the ISO Tariff, an adjustment shall be made in accordance with the ISO Tariff correcting all measurements made by the inaccurate or defective Meter during the Adjustment Period. If the Parties are unable to agree on the amount of the adjustment to be applied to the Adjustment Period, the amount of the adjustment shall be determined: (i) by correcting the error if the percentage of error is ascertainable by calibration, tests or mathematical calculation, or

If a Meter fails to register, or if the measurement made by a Meter is found upon testing to be inaccurate by an amount exceeding plus or minus one percent (1%), an adjustment shall be made correcting all measurements made by the inaccurate or defective Meter during the Adjustment Period. If the Parties are unable to agree on the amount of the adjustment to be applied to the Adjustment Period, the amount of the adjustment shall be determined: (i) by correcting the error if the percentage of error is ascertainable by calibration, tests or mathematical calculation, or (ii) if not so ascertainable, by estimating on the basis of the deliveries under similar conditions during periods when the Meter was registering accurately. Upon the determination of the amount of any adjustment and upon acceptance of such adjustment by the CAISO, if applicable, Buyer shall pay to Seller any additional amounts then due for deliveries of Output during the Adjustment Period at such time as other payments are due for the billing period in which the determination is made, or Buyer shall be entitled to a credit against the next subsequent payments due for the deliveries of Output, whichever case is applicable. The Parties agree to abide by protocols under the CAISO Tariff for handling Meter inaccuracies.
