Our Liability for Failure to Complete Transactions. If we do not complete a transaction from your Account on time or in the correct amount, we will be liable for your losses or damages. However, we are not liable for any failed transaction if you do not have enough money in your balance to cover a transaction, if the ATM or device does not have enough cash or is not working properly, if circumstances beyond our control prevent the transaction, if the merchant requests authorization for an amount greater than the purchase amount, if access to your Account or linked account has been blocked after you reported your Account number or linked account number lost or stolen, if there is a hold or your funds are subject to legal or administrative process or other encumbrance restricting their use, if we have reason to believe the requested transaction is unauthorized, if we have received incomplete or inaccurate information from the third-party payor or payee or if there are other exceptions stated in this agreement or as provided by law. We are not liable for the failure to complete a transaction on a business account if we send you notice that the transaction was not completed.

We will not be liable, for instance: • If, through no fault of ours, you do not have enough money in your Card Account to make the transfer; • If the automated teller machine where you are making the transfer does not have enough cash; • If the electronic terminal where you attempted to make the transaction was not working properly and you knew about the problem when you started the transaction; • If circumstances beyond our control (such as fire, flood, national emergency or computer or communication failure) prevent the transaction, despite reasonable precautions that we have taken; • If a merchant refuses to accept your Card; • If access to your Card has been blocked after you reported your Card or PIN lost or stolen; • If there is a hold or your funds are subject to legal process or other encumbrance restricting their use; • If we have reason to believe the requested transaction is unauthorized; or • as otherwise provided in this Agreement.
Our Liability for Failure to Complete Transactions. In no event will we or the Bank be liable for consequential damages (including lost profits), extraordinary damages, special or punitive damages. We will not be liable, for instance: (1) if, through no fault of ours or of the Bank, you do not have enough funds available in your Card Account to complete the transaction; (2) if a merchant refuses to accept your Card or provide cash back; (3) if an ATM where you are making a cash withdrawal does not have enough cash; (4) if an electronic terminal where you are making a transaction does not operate properly, and you knew about the problem when you initiated the transaction; (5) if access to your Card has been blocked after you reported your Card or Access Code lost or stolen; (6) if there is a hold or your funds are subject to legal process or other encumbrance restricting their use; (7) if we or the Bank have reason to believe the requested transaction is unauthorized; (8) if circumstances beyond our or the Bank’s control (such as fire, flood or computer or communication failure) prevent the completion of the transaction, despite reasonable precautions that we or the Bank have taken; or (9) for any other exception stated in our Agreement with you.

Our Liability for Failure to Complete Transactions. If we do not complete a transfer to or from your Bank account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable: • If, through no fault of ours, you do not have enough money in your account to make a transfer or bill payment; or • If a legal order directs us to prohibit withdrawals from the account; or • If your account is closed or if it has been frozen; or • If the transfer or bill payment would cause your balance to go over the credit limit for any credit arrangement set up to cover overdrafts; or • If you, or anyone you allow, commits any fraud or violates any law or regulation; or • If any electronic terminal, telecommunication device or any part of the electronic fund transfer MyOnlineBanking is not working properly; or · If you have not provided us with complete and correct payment information, including without limitation the name, address, account number, and payment amount for the payee on a bill payment; or • If you have not properly followed the instructions for using MyOnlineBanking; or • If circumstances beyond our control (such as fire, flood or improper transmission or handling of payments by a third party) prevent the transfer or bill payment, despite reasonable precautions taken by us; or • If you did not give us complete, correct and current instructions regarding any transfer; or • If you did not authorize a payment soon enough for the payment to be made, transmitted, received and credited by the Payee on or before the due date; or • If we made a timely payment but the payee did not promptly credit your payment after receipt; or • If your computer malfunctioned for any reason; or · If a transfer could not be completed because MyOnlineBanking system was unavailable, as discussed in Section 16; or • If you or we terminate this Agreement before a transfer is scheduled to occur. There may be other exceptions stated in our Agreement with you. In any case, we will not be responsible for any errors or failures due to any malfunction of your computer or to any unsuitability or incompatibility of your computer that may be associated with the use of an online service, regardless of the cause of the error or failure.

However, there are some exceptions. We will not be liable, for instance: • if through no fault of ours, you do not have adequate funds available on your Card to complete the transfer; • if circumstances beyond our control (such as fire, flood, terrorist attack, national emergency, or computer or communication failure) prevent the completion of the transaction, despite reasonable precautions we have taken; • if access to your Card has been blocked after you reported your Card lost or stolen; • if there is a hold on your Card for any reason; • if your funds are subject to legal process or other encumbrance restricting their use; • if your transfer authorization terminates by operation of law; • if a computer system or mobile device was not working properly and you knew about the problem when you initiated the transaction; • if we have reason to believe that the requested transaction is not authorized; or • as otherwise provided in this Agreement.
Our Liability for Failure to Complete Transactions. If we do not complete an Electronic Funds Transfer to or from your Account on time or in the correct amount according to this Agreement, we will be liable for your losses or damages. However, there are some exceptions. None of us will be liable IF: ● through no fault of ours, you do not have a sufficient Available to Withdraw balance to make the Transaction; ● any ATM, other device, Debit Card or computer system was not working properly and you knew about the breakdown when you started the Transaction; ● the ATM or other device you are using for the Transaction does not have enough cash or was otherwise unable to process the Transaction; ● your Account is frozen or otherwise restricted (for example, because of a court order or other similar reason) and we are not permitted to make the Transaction; ● circumstances beyond our control (such as fire or flood) prevent the Transaction, despite the reasonable precautions that we have taken; ● you have failed to enter your correct PIN after the maximum number of attempts permitted; ● you failed to use the ATM, other device, Debit Card or computer system in accordance with instructions; ● we have limited or refused to complete Transactions for security reasons; or ● we have reason to believe that the requested Transaction is unauthorized. There may be additional exceptions stated elsewhere in this Agreement or otherwise notified to you by us or in your other agreements with Aspiration. None of us will be responsible for any person’s actions in refusing to honor or accept your Debit Card or in taking possession of your Debit Card. In any case, we will be liable only for actual proven damages if the failure to make the Transaction resulted from a bona fide error by us despite our procedures to avoid such errors.
