Common use of Military and Peace Corps Leave Clause in Contracts

Military and Peace Corps Leave. (a) An employee who is drafted or otherwise called to active duty, or who leaves his position for extended active duty in the military service of the United States during a state of war or national emergency, shall be granted a military leave for the duration of such war or national emergency. He shall be entitled to return to his position provided his discharge from the service is not dishonorable and he is able to pass a health examination given by a medical examiner selected by the Chancellor. Application must be made within sixty (60) days following his discharge from the service. (b) During the period of such authorized military leave, the Board will continue to pay all required employee contributions to the fund of the State Universities Retirement System. (c) With regard to employees other than Project Employees, restoration shall be at the step and grade held at the beginning of military leave plus any advancement in salary steps that the employee would have been granted had he been continuously employed and complied with requirements for salary step increases. (d) An employee who leaves his position to serve with the United States Peace Corps will be afforded the same benefits except that contributions to the retirement fund will not be made by the Board during Peace Corps leave and Peace Corps leaves may not exceed two (2) calendar years. (e) An employee may take short leaves of absence to perform temporary active duty with Reserve or National Guard units. During such leave of absence and while engaged in the performance of such military duty, an employee will be paid his basic salary provided he remits to the Board any sums of money paid to him as compensation for the performance of such military duty.
