Minimum Staffing. ‌ It shall be the responsibility of the Chief and /or Officer in charge of the on-duty shift to maintain a minimum of six (6) fire department personnel on duty, consisting of one (1) officer plus four (4) private fire fighters and one (1) civilian dispatcher, so as to properly fulfill the public safety responsibilities of the Fire Department. The Fire Inspector may be counted toward these minimum requirements as a private fire fighter. New private fire fighters shall not be counted toward the minimum staffing requirements until they have completed ninety (90) days on the Fire Department. New private fire fighters hired with more than one (1) year of experience as paid fire fighters from another paid fire department shall be counted after sixty (60) days. The Town and Union agree to meet and discuss possible increases to the Minimum Staffing of the Fire Department if an additional station or additional territory is added to the public safety responsibilities of the Middletown Fire Department during the term of this Agreement. The parties understand that the Town may employ part time and/or full time civilian personnel to serve as dispatchers. Members who currently serve as dispatchers will be assigned to line fire/rescue platoons. Fulltime civilian dispatchers will be members of the bargaining unit and will receive the benefits and be subject to the terms and conditions set forth in the Town’s Personnel Ordinance unless otherwise specified by the express mention of civilian dispatchers, in a section or sections of this Agreement. Fulltime civilian dispatchers shall receive retirement benefits on the same terms as are applicable to the hourly employees in the Department of Public Works (e.g., those hired before July 1, 2012 shall be enrolled in the general Municipal Employees Retirement System, as amended, and those hired on or after July 1, 2012 shall be enrolled in a defined contribution plan only on the same terms as hourly DPW employees), and shall be eligible to receive health, dental, and life insurance coverage during the term of their employment on the terms set forth in this Agreement.. No other term of this Agreement shall be construed as mentioning or having reference to civilian dispatchers nor to have any application to civilian dispatchers who are members of the bargaining unit unless that term specifically states that it is “applicable to civilian dispatchers.” Those articles of their Agreement that shall be applicable to civilian dispatchers who are members of their bargaining unit shall be Articles 1, 2, 3, 4, 8, 12, 28, 30 ,38(b), and 39 only. Civilian dispatchers’ wage rates are attached at Appendix II. Any civilian dispatcher possessing at least a current State of R.I. EMT-B certification upon hiring, shall enter at Step B as set forth in Appendix II. All CPR, First Aid, and EMT-B certifications held by civilian dispatchers shall be refreshed in the same manner as is currently provided for Fire Department personnel. The Lieutenant positions shall remain vacant until such time as both parties agree to fill them.

The Fire Inspector may be counted toward these minimum requirements as Probationary firefighters who are temporarily assigned to a private fire fighter. New private fire fighters work platoon shall not be counted count toward the minimum staffing requirements until they have completed ninety (90) days requirement. Probationary firefighters assigned to the training division or a training schedule shall not count toward minimum staffing. All fill-ins for absences to maintain the six employee minimum on the Fire Department. New private fire fighters hired with more than one (1) year of experience as paid fire fighters from another paid fire department duty shall be counted after sixty (60) days. The Town and Union agree to meet and discuss possible increases to the Minimum Staffing by permanent employees of the Barrington Fire Department if an additional station or additional territory is added to at the public safety responsibilities of the Middletown Fire Department during the term of this Agreement. No . When hiring back personnel on overtime to meet minimum staffing the department shall offer the overtime to a person of equal rank prior to offering it to a lower rank. For example: If a captain is on vacation the overtime shall be offered to the other term captains first before offering to lower ranks. In the event there are two vacancies on a shift but minimum xxxxxxx dictates only one callback person is necessary, and one or both of the vacancies is an officer vacancy, the higher ranking officer position will be offered the overtime first. For example: A captain and a lieutenant are both out sick and minimum staffing requires hiring back one person to meet minimum xxxxxxx, the captains shall be offered the overtime first, followed by the lieutenants, then the firefighters. Another example is a lieutenant, and a firefighter, are both on sick leave, lieutenants will be offered the overtime first, followed by the firefighters. The Town of Barrington agrees that any reduction in the size of its paid municipal Barrington fire department will be by attrition and not by forced layoff, except for any individual removed for cause. (February 1993, negotiated settlement) ARTICLE XIV Section 1. CLOTHING Clothing for all employees of the Barrington Fire Department covered by this Agreement shall be construed as mentioning provided or having reference to civilian dispatchers nor to have any application to civilian dispatchers who are members within the Town of the bargaining unit unless that term specifically states that it is “applicable to civilian dispatchers.” Those articles of their Agreement that Barrington Fire Department's budget and shall be applicable of sufficient quantity to civilian dispatchers who are members adequately clothe its personnel with the following items: -Ties (black) (as required) -Shoes (black) (annually) -Four (4) NFPA 1975 compliant station uniforms comprised of their bargaining unit two (2) long and two (2) short sleeve polo shirts and 4 pairs of pants shall be Articles 1, provided bi-annually. Local 1774 and the Fire Chief shall together determine a style of polo shirt that is deemed appropriate for use. -Uniform hat (as required) -Work jacket (bi-annual) - Sweat shirt and two (2, 3, 4, 8, 12, 28, 30 ,38(b), ) tee shirts (annual) -Dress blue uniforms and 39 only. Civilian dispatchers’ wage rates are attached at Appendix II. Any civilian dispatcher possessing at least a current State of R.I. EMT-B certification upon hiring, top coats for dress uniforms shall enter at Step B as set forth in Appendix II. All CPR, First Aid, and EMT-B certifications held by civilian dispatchers shall not be refreshed in the same manner as is currently provided for Fire Department personnel. Minimum Staffing. ‌ It The City is committed to maintaining Fire Department staffing at three (3) firefighters for each in-service company with a minimum of 2 in-service companies. Staffing of an in-service company shall normally consist of a fire captain and two firefighter- EMT’s, or an acting fire captain/crew chief and two firefighter-EMT’s. Qualified part-time and student resident firefighters may be used to meet minimum staffing requirements, so long as there is at least one full-time employee assigned as the fire captain/crew chief and one Firefighter/EMT for each in-service company. If sufficient personnel are not available to meet the minimum staffing requirements, employees shall be retained past the responsibility end of the Chief and /or Officer in charge of the their scheduled shifts until sufficient on-duty personnel are available to meet the normal minimum staffing requirements. This process should begin with the least senior employee and progress through remaining on-duty personnel in that order. An employee may not be retained past the end of their shift to maintain more than two times within a minimum of six (6) fire department personnel on duty, consisting of one (1) officer plus four (4) private fire fighters and one (1) civilian dispatcher, so as to properly fulfill thirty-day period from the public safety responsibilities initial mandated shift without permission of the Fire DepartmentChief (or designee). The Fire Inspector Considerations shall be made if the employee being retained will be subjected to an unresolvable compromise in the care of a child, spouse, or parent. This excludes siblings, in-laws, and grandparents. If all off-duty full-time and shift qualified part-time have been contacted and are unable to fill-in, and prior to an employee being held over that is subjected to a hardship described above, alternative apparatus staffing may be counted toward these used. Alternative apparatus staffing consists of an employee that has Firefighter I and II and has completed the department’s orientation program. Alternative staffing may be used for the fill-in so long as there are two (2) EMTs on the apparatus. If a Firefighter-EMT becomes available to meet minimum requirements as a private fire fighterstaffing, the alternative staffing shall be replaced and be paid two-hours or actual time worked, whichever is greater. New private fire fighters Alternative Apparatus Staffing shall be in effect anytime that the part-time staff falls below fifty percent (50%) of authorized staffing. Any person held over shall be notified by no later than 0730 hours of the decision that they are to be held over. Additional equipment may be staffed to supply the needs of the Department from time to time and the qualifications of the personnel may not be counted toward the minimum staffing requirements until they have completed ninety (90) days on the Fire Department.
