MINORITY AND WOMEN BUSINESS ENTERPRISES. (M/WBE) Delete this section in its entirety if the total project cost is less than $50,000. 00.0. Xx is the policy of the State of Vermont that M/WBE's shall have the maximum opportunity to participate in the performance of contracts financed with state funds. All Bidders are encouraged to contact M/WBE's in an effort to recruit them to submit proposals for the work or portions thereof. The contractor shall not discriminate on the basis of race, color, national origin or sexual orientation in the award and performance of subcontracts. The Department of Buildings and General Services shall, in accordance with Executive Order #15-91, and for publicly funded capital construction projects exceeding $50,000.00, comply with the following provisions and requirements. Upon receipt of letter of intent to award contract, the successful bidder shall submit an M/WBE Reporting Form along with certificates of insurance and other pre-contract information. The form includes space to report the name, address and phone number of the M/WBE's contacted, the trade, if their price was included in the bid proposal, and if not, the reason for rejection of their bid. The contract will not be executed until the M/WBE Form is received. Failure to contact M/WBE's on or when projects require sub-contract work may constitute non-compliance and may result in forfeiture of future bidding privileges until resolved.
MINORITY AND WOMEN BUSINESS ENTERPRISES. It is the City’s policy to ensure that Minority and Women Business Enterprises ("MWBEs") have the full opportunity to compete for and participate in City contracts. The objectives of Chapter 15, Article V of the City of Houston Code of Ordinances, relating to City-wide Percentage Goals for contracting with MWBEs, are incorporated into this Agreement. Consultant shall make good faith efforts to award subcontracts or supply agreements in at least % of the value of this Agreement to MWBEs. The City’s policy does not require Consultant to in fact meet or exceed this goal, but it does require Consultant to objectively demonstrate that it has made good faith efforts to do so. To this end, Consultant shall maintain records showing: (1) subcontracts and supply agreements with Minority Business Enterprises, (2) subcontracts and supply agreements with Women’s Business Enterprises, and (3) specific efforts to identify and award subcontracts and supply agreements to MWBEs. Consultant shall submit periodic reports of its efforts under this Section to the Office of Business Opportunity (“OBO”) Director in the form and at the times he or she prescribes. Consultant shall ensure that all subcontracts with MWBE subcontractors and suppliers will permit representatives of the City of Houston, at all reasonable times, to perform audits of the books and records of the subcontractor. Subcontractor shall keep such books and records available for such purpose for at least four (4) years after the end of its performance under this subcontract. Nothing in this provision shall affect the time for bringing a cause of action nor the applicable statute of limitations. Consultant shall ensure that all subcontracts with MWBE subcontractors and suppliers contain the following terms: 1. ( MWBE subcontractor) shall not delegate or subcontract more than 50% of the work under this subcontract to any other subcontractor or supplier without the express written consent of the City of Houston's OBO Director ("the Director").

All agreements must contain the terms set out in Exhibit "F." If Contractor is an individual person (as distinguished from a corporation, partnership, or other legal entity), and the amount of the subcontract is $50,000 or less, then the subcontract must also be signed by the attorneys of the respective parties.

MINORITY AND WOMEN BUSINESS ENTERPRISES. Contractor hereby agrees to comply with the following when applicable: The requirements of Executive Orders 11625 and 12432 (concerning Minority Business Enterprise), and 12138 (concerning Women's Business Enterprise), when applicable. Accordingly, the contractor hereby agrees to take affirmative steps to assure that women and minority businesses are utilized when possible as sources of supplies, equipment, construction, and services. Affirmative steps shall include the following: I. Including qualified women’s business enterprises and small and minority businesses on solicitation lists; II. Assuring that women’s enterprises and small and minority businesses are solicited whenever they are potential sources; III. When economically feasible, dividing total requirements into smaller tasks or quantities so as to permit maximum participation by small and minority business, and women’s business enterprises; IV. Where the requirement permits, establishing delivery schedules which will encourage participation by women’s business enterprises and small and minority business; and V. Using the services and assistance of the Small Business Administration, and the U.S. Office of Minority Business Development Agency of the Department of Commerce; and/or the Mississippi Procurement Technical Assistance Program (xxxxx://xxxxx.xxx).
