Monthly Quantities. If a Party wishes to vary the delivery of the Monthly Quantities in the Operational Plan, it must notify the other Party no later than 7 days prior to the commencement of the relevant month. VicForests and the Buyer must, acting reasonably, negotiate in good faith to reach agreement on such proposed amendment. To avoid any doubt, unless both Parties agree in writing that a variation to any Monthly Quantity constitutes an amendment to the Operational Plan, any lesser Monthly Quantity delivered by VicForests to Buyer at Buyer’s request will contribute toward the calculation of Forfeited Timber.

Monthly Quantities. BEF shall provide SUN in writing at least fifteen (15) days prior to the first day of each Month a schedule indicating the quantity of Product to be delivered by BEF in such Month.
Monthly Quantities. The quantity of Product to be delivered pursuant to Section 2.2 shall be taken in approximately equal monthly quantities over the course of the particular calendar year. The Parties will reasonably cooperate with each other in connection with forecasting, ordering and delivery schedules and procedures. If after the Commencement Date General Moly fails to deliver the quantity of Products required to be delivered pursuant to this Agreement for a period of two consecutive months, Buyer shall have the right to require that General Moly supply such shortfall in subsequent months, subject to Available Production, at such Product Price as would have applied if the Products had been shipped pursuant to the originally agreed delivery schedule. This is a best effort supply agreement based on the Available Production of Mount Hope Mine with no recourse to short supply except to allow it to be made up in future months, at Buyer’s request, when supply is available.

  • CONTRACT YEAR A twelve (12) month period during the term of the Agreement commencing on the Effective Date and each anniversary thereof.

  • Quantity If Seller delivers more than the quantity of Goods ordered, Buyer may reject all or any excess Goods. Any such rejected Goods shall be returned to Seller at Seller's risk and expense. If Buyer does not reject the Goods and instead accepts the delivery of Goods at the increased or reduced quantity, the Price for the Goods shall be adjusted on a pro-rata basis.

  • Production Royalty The amount of the Royalty shall be determined at the end of each month after the Effective Date. The Royalty shall be determined monthly on the basis such that payments will be determined as of and paid within thirty (30) days after the last day of each month during which Lessee produces any Geothermal Resources. The Royalty rates shall be determined as follows:

  • Quality Specifications SANMINA-SCI shall comply with the quality specifications set forth in its Quality Manual, incorporated by reference herein, a copy of which is available from SANMINA-SCI upon request.
