The 'Network Rail payments' clause defines the obligations and procedures for making payments to or from Network Rail under the contract. Network Rail payments. Subject to paragraph 2.3, Network Rail shall make payments to the Train Operator (in accordance with the procedure in paragraph 13) in respect of a Network Rail Restriction of Use calculated in accordance with paragraphs 2.5 to 2.7 and 2.10 where applicable.
Network Rail payments. (A) The provisions in this paragraph regarding payments by Network Rail shall apply to Possessions notified by Network Rail to Nexus.
(B) Subject to paragraphs 2.2, 2.3 and 2.4, Network Rail shall make payments to Nexus for Possessions taken on or in relation to the Route on the following basis:
(i) for each Network Rail Possession which is outside the Possessions Allowance or is taken outside the Free Period, in accordance with paragraph 3; and
(ii) for each Competent Authority Possession, in accordance with paragraph 5.
