Newark. If the parties are unable to resolve a Dispute between themselves pursuant to Section 12.2, then, if both parties mutually agree to submit the Dispute to binding arbitration, then the disputing party may initiate binding arbitration in Trenton, New Jersey, conducted in accordance with the then current American Arbitration Association’s (“AAA”) Large, Complex Commercial Rules or other mutually agreed procedures. If the parties do not mutually agree to submit a Dispute to binding arbitration, then either party may initiate a proceeding in a court of competent jurisdiction with respect to the Dispute.

  • Missouri CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Service Agreement.
