No Guarantee of Performance. The parties hereto acknowledge and agree that the Advisors cannot guarantee the results or effectiveness of any of the Services to be performed by Advisors. Rather, the Advisors shall conduct their operations and provide their services in a professional manner and in accordance with good industry practice and all federal, state and local laws. Consultant will use its best efforts and does not promise or guarantee results.
No Guarantee of Performance. The Trading Advisor makes no promises, representations, warranties, or guarantees that any of its trading services rendered to the Series will result in a profit or will not result in a loss to the Series.
No Guarantee of Performance. 5.1 You acknowledge that the amount of electricity You produce using the Solar Equipment will depend on a number of factors such as:
(a) the number of hours of sunlight per day;
(b) cloud cover and weather patterns;
(c) the location, pitch and direction of the Solar Equipment;
(d) the location of surrounding structures and trees; and/or
(e) maintenance and general cleanliness of the panels.
5.2 We will try to make sure that the Solar Equipment is installed in a position that will maximise its performance for You, taking into account the nature of the Property.
5.3 It is Your responsibility to have the Solar Equipment cleaned. Due to the risk associated with accessing a roof, We recommend that You do not clean the Solar Equipment Yourself, and instead use a specialist cleaning company to do this for You. Any activities undertaken to clean the Solar Equipment are at Your own cost and risk.
5.4 We accept no responsibility if performance of the Solar Equipment does not meet Your expectations.
5.5 We do not make any representation, warranty or guarantee that the Solar Equipment will continue to function beyond the expiry of the manufacturer's warranty period(s).
No Guarantee of Performance. (a) The performance of the System is subject to a number of variable factors including but not limited to the number of hours of sunlight, cloud cover and weather patterns, the location of the System and the location of surrounding structures and flora.
(b) Solar Service Guys will use its reasonable endeavours to install the System in a position that is likely to maximise its performance unless requested otherwise by you.
(c) Solar Service Guys does not guarantee the performance of any System other than as outlined in the quotation and associated documentation and accepts no responsibility if the performance is lower than anticipated. This does not affect or diminish Solar Service Guys’s or the manufacturers’ warranties in relation to the System and its components.
No Guarantee of Performance. Adviser understands that the value of investments made for the Fund(s) may increase as well as decrease, is not guaranteed and past performance is no guarantee of future results. Sub-adviser has not made and is not making any guarantees, including any guarantee as to any specific level of performance of the Fund(s) or the performance of the Fund(s) relative to any standard or index, including other clients of Sub-adviser. Adviser acknowledges that each Fund is designed for the described investment objective and is not intended as a complete investment program and also understands that investment decisions made on behalf of the Fund by Sub-adviser are subject to various market and business risks.
No Guarantee of Performance. 14.1 The performance of a System is subject to a number of variable factors, including, but not limited to the number of hours of sunlight, cloud cover and weather patterns, the location of the System and the location of the surrounding structures and flora.
14.2 We may provide you with an estimate about the performance of the System prior to entering this Contract but this will be based on generic forecasting tools available to us at the time relating to factors as described in, but not limited to, clause 14.1.
14.3 Except to the extent required by law, we do not guarantee the performance of, and will accept no responsibility in the event that the performance of any System is lower than anticipated.
No Guarantee of Performance. 16.1 For solar electricity, the performance of a System is subject to a number of variable factors, including, but not limited to: the number of hours of sunlight, cloud cover and weather patterns; the location of the System; and the location of the surrounding structures and flora.
16.2 Except to the extent required by law, we do not guarantee the performance of, and will accept no responsibility in the event that the performance of any solar electricity System is lower than anticipated.
No Guarantee of Performance. The Credit Linked Notes constitute direct, unsubordinated and unsecured obligations of the Issuer that are linked to the credit risk of each Reference Entity and/or Reference Obligation specified in the relevant Final Terms. No Programme Party guarantees the performance of or otherwise stands behind the performance of any Reference Entity or Reference Obligation or is under any obligation to make good losses suffered as a result of Credit Events.

10.2 Except to the extent required by law, Captain Green Solar does not guarantee the performance of, and will accept no responsibility in the event that the performance of any so solar system package is lower than anticipated.
