No Re-Identification. With respect to the use of the Subscribed Output, Customer represents and warrants that: (i) it does not have the ability to use the Subscription and the Subscribed Output to determine the identity of any specific person; (ii) it shall make no attempt to obtain data permitting it to use the Subscription and the Subscribed Output to determine the identity of any person; (iii) it will not accept any information from any third party that permits the use of the Subscribed Output to make such an identification; and (iv) it will make no such identification.

No Re-Identification. Except with the express, written permission of Network Participant and IRB approval, the Coordinating Center agrees not to re-identify or attempt to re-identify individuals whose information is contained in any dataset returned to the CC in response to a Query. In its role as a CC, the CC shall not attempt to contact any patient whose information is provided hereunder unless required to do so by law or government regulation, or as permitted under a documented IRB partial waiver of the HIPAA authorization requirement for recruitment purposes only consistent with an IRB-approved protocol. In any event, the CC will provide written notice to Network Participant and the IRB prior to such contact.

No Re-Identification. Except as specifically permitted by ISMMS and any necessary BioMe Subject consent, Sema4 shall not attempt in any manner, directly or indirectly, to identify the BioMe Subjects or their family members, or to enable any third party to do so, and shall not contact any BioMe Subject if identified for any reason. Sema4 shall notify ISMMS immediately if Sema4 identifies a BioMe Subject, or if it becomes aware that a Subcontractor or Sema4 Collaborator has identified such an individual. Sema4 agrees to destroy any remaining Biospecimens, Xxxxxxxx Xxxx or Clinical Data related to a BioMe Subject who has been so identified.
