Non-Exclusive Use Areas. Tenant shall also have the non-exclusive right to use, in common with other tenants in the Building, any and all of the following areas which may be appurtenant to the Premises: common entrances, lobbies, elevators, stairways and access ways, loading and unloading areas, visitor parking areas, ramps, drives, platforms, public restrooms, and common walkways and sidewalks necessary for access to the Premises.

Non-Exclusive Use Areas. The Coops shall also have the non-exclusive right to use, in common with other adjacent tenants, any and all of the following areas which may be appurtenant to the Premises: common entrances, lobbies, elevators, stairways and access ways, loading and unloading areas, visitor parking areas, ramps, drives, platforms, public restrooms, and common walkways and sidewalks necessary for access to the Premises.
Non-Exclusive Use Areas. Non Exclusive Use Areas, including the adjacent parking lot, are depicted in Exhibit A. Tenant acknowledges that the adjacent parking lot is outside the leased premises, is shared with the Public, and Marina slip holders. Tenant acknowledges that Tenant has non-exclusive use of the parking lot and associated improvements, and that Tenant is responsible for maintenance of the landscaping and lighting in the Non-Exclusive Use Areas in good condition, as described in section 5.6.
Non-Exclusive Use Areas. Tenant also desires to have non-exclusive use of several areas located within and outside of the Processing Building (“Non-Exclusive Use Areas”). Non-Exclusive Use Areas for the Tenant within the Processing Building include: an approximately 8,500 square foot portion of the residuals transfer area within the Processing Building (“RTA”), an approximately 1,500 square foot area to offload residuals known as Residuals Loadout Bay 4 (“Bay 4”) with pedestrian pathway from Bay 6, and the lunchroom and restrooms. Certain other pedestrian pathways shown in Exhibit C within the Sorting Line Area and near the Office, lunchroom and restrooms will remain available to the District for general access, maintenance and repair activities. Non-Exclusive Use Areas outside the Processing Building include: the Inbound and Outbound Scales; the Employee Parking Area and Employee Walkway to the Processing Building; and an approximately 6,700 square foot portion comprising the southern five of nine Loading Docks (the “Non-Exclusive Loading Docks”). The Non-Exclusive Loading Docks are available to Tenant from 5:00 am to 2:00 pm, Mondays through Saturdays, and otherwise remain exclusively available to District. Tenant further desires to have non-exclusive use of (1) Access Routes for Necessary Equipment (defined below) (“Access Routes for Necessary Equipment”) (2) Access Routes around the Processing Building as depicted on Exhibit B, and (3) the Access Route from Crossroads Parkway South as depicted on Exhibit A. Collectively, the portions of the PHMRF that Tenant may use non-exclusively pursuant to the express provisions of this Lease (as depicted on Exhibits A, B and C) constitute the “Non-Exclusive Use Areas”.

  • Non-Exclusive Use i. Lessor hereby grants Lessee the non-exclusive use of the Airport (together with all Improvements, runways, ramps, conveniences and appurtenances thereunto) in common with Lessor and other present and future lessees of Lessor, except such Improvements specifically leased herein and as may be leased by Lessor to other lessees presently or in the future.

  • Excessive Use 4.11 If Your use of the Services is deemed by Us to be in excess of that which is normal for the Service which You have purchased, We may at Our discretion require You to move onto another Service which is more suitable for Your requirements.
