Non-Office 365 by Xxxxxx Software. Customer is solely responsible for any non-Office 365 delivered by Xxxxxx’ software that it installs or use with Office 365 delivered by Xxxxxx. Xxxxxx is not a party to and is not bound by any terms governing Customer’s use of non-Office 365 delivered by Xxxxxx software. Without limiting the foregoing, non-Office 365 delivered by Xxxxxx software or scripts linked to or referenced from any Office 365 delivered by Xxxxxx website, are licensed to Customer under the open source licenses used by the third parties that own such code, not by Xxxxxx. If Customer installs or uses any non-Office 365 delivered by Xxxxxx software with Office 365, Customer directs and controls the installation in and use of such software in Office 365 through its actions (e.g., through Customer’s use of application programming interfaces and other technical means that are part of Office 365). Xxxxxx will not run or make any copies of such non-Office 365 delivered by Xxxxxx software outside of its relationship with Customer. If Customer installs or uses any non-Office 365 delivered by Xxxxxx software with Office 365 delivered by Xxxxxx, it may not do so in any way that would subject Xxxxxx’ or its licensor’s intellectual property or technology to obligations beyond those included in these Terms.

  • Application to the Office of Rail and Road XXX shall have the right under the Contracts (Rights of Third Parties) Xxx 0000 to enforce directly such rights as have been granted to it under this contract.

  • AT&T-22STATE and CLEC agree to provide the other Party with notification of any discovered errors in the record exchange process within ten (10) Business Days of the discovery.

  • AT&T-12STATE acknowledges that CLEC may have an embedded base of one-way trunks ordered and installed prior to the Effective Date of this Agreement that were used for termination of CLEC’s Section 251(b)(5)/IntraLATA Toll Traffic to AT&T-12STATE (Embedded Base). To the extent that CLEC has such an Embedded Base, CLEC shall only augment trunk groups in the Embedded Base with the mutual agreement of the Parties. CLEC shall not order any new one-way trunk groups following the Effective Date of this Agreement. Moreover, the Parties agree that the Embedded Base will be converted to two-way trunk groups under the following circumstances:
