Non-Reappointment Based on Institutional Factors. If UCMC intends to reduce the size of the Residency Program or to close the Residency Program to which Resident is assigned (collectively, “Institutional Factors”), the Residency Program will inform the affected residents as soon as possible. In the event of such a reduction or closure, the Residency Program will make reasonable efforts to allow residents already in the Residency Program to complete their education or will make reasonable efforts to assist them in enrolling in another ACGME accredited program in which they can continue their education. When non-reappointment is based on Institutional Factors, such non-reappointment when made by the Residency Program shall be final and not subject to further appeal or review. Such non-reappointment is not a reportable action.

Non-Reappointment Based on Institutional Factors. When non- reappointment is based on reasons other than the Physician-in-Training’s performance or his or her compliance with the terms of this Agreement, such non-reappointments when made by the Medical Center shall be final and not subject to further appeal or review and shall not be subject to the fair hearing process as described on Attachment “M,” attached hereto, and incorporated by this reference.

Non-Reappointment Based on Institutional Factors. When non-reappointment is based on The University of Toledo’s business decisions, or considerations exclusively related to The University of Toledo as an institution, or other reasons apart from the Resident’s performance, action or conduct, qualifications, credentials, licensure or professional standing, including but not limited to, withdrawal or suspension of training certificate or permanent license by the Ohio State Medical Board, such non-reappointment will be final and not subject to further appeal or review granted by The University of Toledo’s Due Process Procedures set forth in GME Policy 3364-86- 008-00.
