NOTICE AND ADMINISTRATION EXPENSES. Except as otherwise provided herein, the Net Settlement Fund shall be held in the Escrow Account until the Effective Date.
NOTICE AND ADMINISTRATION EXPENSES. At any time subsequent to the funding of the Initial Escrow Account and the preliminary approval of the Settlement by the Court, and subject to Xx. Xxxxx’x having obtained the approval of the RBI, without further order of the Court, the Initial Escrow Agent shall, upon request from Lead Counsel, pay up to $400,000 from the Initial Escrow Account to pay the Notice and Administration Expenses actually incurred.

At any time subsequent to the funding of the Initial Escrow Account and the preliminary approval of the Settlement by the Court, without further order of the Court, the relevant escrow agent shall, upon request from Lead Counsel, pay up to $250,000 from the relevant escrow account established pursuant to this Stipulation to pay the Notice and Administration Expenses, for notice and administration expenses actually incurred in excess of the initial $250,000, which shall be paid out of the settlement fund established in connection with the Xxxxxx Settlement. Lead Counsel shall provide the Settling Defendants’ Counsel an itemized accounting of the Notice and Administration Expenses actually incurred.
NOTICE AND ADMINISTRATION EXPENSES. Defendants have agreed to pay the Notice and Administration Expenses. The Settlement Administrator shall invoice and be paid by Defendants for Notice and Administration Expenses. Within one-hundred eighty (180) days from the date on the Payment Notices, any excess funds remaining in the Settlement Fund shall be applied as follows: (i) 50% of any excess funds remaining in the Settlement Fund shall be applied to the costs of Notice and Administration by the Settlement Administrator prior to submitting final invoice to Defendants’ Counsel; and (ii) 50% any excess funds remaining in the Settlement Fund shall be paid to the Neighborhood Legal Services of Western Pennsylvania, subject to court approval.

NOTICE AND ADMINISTRATION EXPENSES. 10.1 Per Paragraph 4.1.1, all costs of notice and administration, including, without limitation, the fees and expenses of the Claims Administrator, costs associated with determining the validity of a Claim and Service Award, shall be paid by Schnucks as part of the Class Settlement Amount. The payment of any Service Award will be paid to Class Counsel consistent with Paragraphs 11.3 and 11.4 below.

Prior to the Effective Date, without further approval from Defendants or further 18 order of the Court, Lead Counsel may expend up to $250,000 from the Settlement Fund to pay 19 Notice and Administration Expenses actually incurred. Additional sums for this purpose prior to 20 the Effective Date may be paid from the Settlement Fund upon agreement of the Parties or order of 21 the Court. Taxes and fees related to the Escrow Account and investment of the Settlement Fund 22 may be paid as incurred, without further approval of Defendants or further order of the Court. After 23 the Effective Date, without approval of Defendants or further order of the Court, Notice and 24 Administration Expenses may be paid as incurred.
NOTICE AND ADMINISTRATION EXPENSES. 47. All costs of notice and administration, including, without limitation, the fees and expenses of the Claims Administrator and Claims Referee, shall be paid separately by Xxxxx directly to the Claims Administrator, Claims Referee, or other party.
