Notice Dates. Seller shall provide Buyer notice at least one hundred eighty (180) days prior to Seller’s projected Date of First Delivery, setting forth Seller’s best estimate of the range of potential dates for Date of First Delivery covering a forty-five (45) day period. Approximately sixty (60) days prior to Seller’s projected Date of First Delivery, Seller shall provide Buyer with Seller’s best estimate of the projected Date of First Delivery covering a range of ten (10) days, and shall update such estimate on a weekly basis.
Notice Dates. 1. Except for a faculty member on terminal or visiting ranked appointment, reappointment will be presumed unless there is written notification of non-reappointment no later than:
a. April 1 in the first year of service as to whether a faculty member shall be reappointed to a second year of service.
b. March 1 in the second year of service as to whether or not a faculty member’s third year
c. April 1 of the third year of service as to whether or not the faculty member’s fourth year of service shall be his/her last year of employment with the Colleges.
d. April 1 of the fourth year of service as to whether a faculty member shall receive a two- year appointment to fifth and sixth years or whether the fifth year of service shall be the faculty member’s last year of employment with the Colleges. This date does not apply if the faculty member has already been notified in his/her third year that the fourth year will be the terminal year of employment.
e. May 1 of the sixth year of service as to whether a faculty member shall be tenured effective at the beginning of his/her seventh year of service or whether such seventh year of service shall be the faculty member's last year of employment with the Colleges.
Notice Dates. All notices sent by registered letter in connection with this lease agreement shall be considered as duly given on the day they are deposited at the post office, with the date on the deposit slip serving as proof.
Notice Dates. The Notice Date with respect to each Expansion Area shall be as follows:
(1) Notice Date for First Expansion Area: January 31, 2005
(2) Notice Date for Second Expansion Area: October 31, 2008
(3) Notice Date for Third Expansion Area: October 31, 2010
Notice Dates. Ninety (90) days prior to the anticipated Date of First Delivery, Seller shall provide Buyer with a best estimate of a projected Date of First Delivery covering a range of thirty (30) days. Forty-five (45) days prior to the projected Date of First Delivery, Seller shall provide Buyer with a best estimate of a projected Date of First Delivery covering a range of seven (7) days. Seller and Buyer agree that Seller shall not incur any liability for any failure of the Date of First Delivery to occur on the projected date in the notices as estimated by Seller in good faith.
Notice Dates. In the United States, subject to approval by the MDL Court, the Class Notice shall be reasonably disseminated in the United States within fifteen (15) days of the entry of the Preliminary Approval Order by the MDL Court (the “U.S. Notice Date”). In Canada, subject to approval by the Canadian Courts, the Class Notice shall be reasonably disseminated in Canada within seven (7) days of the last order approving the Class Notice being granted by a Canadian Court as contemplated by § II.B.2. above (“Canadian Notice Date”).
Notice Dates. The Notice Date in respect of each Expansion Area shall be defined as follows:
(1) If, as of the date twelve (12) months prior to the first day of the Expiration Period in question, any portion of the Expansion Area is vacant, the Notice Date in respect of such Expansion Area shall be the date twelve (12) months prior to the first day of the Expiration Period applicable to such Expansion Area.
(2) If, as of the date twelve (12) months prior to the first day of the Expiration Period in question, all of an Expansion Area is occupied by an Expansion Area Tenant(s), then the Notice Date in respect of such Expansion Area shall be twelve (12) months prior to the earliest expiration date of the lease of the Expansion Area Tenant of such Expansion Area. Landlord shall advise Tenant, upon request of Tenant from time to time, of the expiration dates of the terms of the leases of the tenants of the fifth (5th) floor of the Building.
(3) Landlord shall, upon written request of Tenant, advise Tenant of the expiration dates of the leases of all Expansion Area Tenants and of the corresponding Notice Dates, if applicable, and the location of the portion of the Expansion Area leased to such tenants. Notwithstanding anything to the contrary herein contained, after Landlord has advised Tenant of a Notice Date in respect of an Expansion Area, such Notice Date shall in no event occur earlier than the date which Landlord has so advised Tenant.
